Toth Defends Actions After Mayor's Accusation

Acropolis: Toth tried to help his business clients' permit approvals expedited

During a heated discussion on a proposed Brick municipal government restructuring plan, Mayor Stephen C. Acropolis implied Councilman Dan Toth – a fellow Republican – was supporting the ordinance in order to oust Deputy Business Administrator Juan Bellu from his position in township government after he notified Acropolis of e-mails Toth had sent.

Bellu's job would be eliminated under the restructuring plan, which passed and is now expected to be vetoed by Acropolis.

Acropolis read from e-mails sent to Bellu from Toth, who was asking about the progress of permit approvals for two liquor stores, Tenali Wines and Joe Canals.

Toth is in the liquor business and often abstains from liquor license votes at council meetings, citing a potential conflict of interest.

In one e-mail from Bellu to Acropolis, which Acropolis read, Bellu said Toth had asked him to "expedite" a certificate of occupancy issuance to a liquor store because the owner had purchased inventory and would be required to pay his suppliers.

"I guess when you're in public you abstain, but in private, you call to help people you have a financial interest in," said Acropolis.

Toth said after the meeting that he has personally called township officials on behalf of both citizens and business owners including, recently, a woman from Herbertsville who spotted what turned out to be an overcharge on her property tax bill.

He said he also called township officials when permits for Nick Catone's Mixed Martial Arts academy were delayed.

"We are their conduit," said Toth, referring to business owners and township residents.

In the case of the owner of Tenali Wines, Toth said, the two had known each other "seven years before I even became a councilman" and the message sent to Bellu was simply acting on behalf of a friend and taxpayer who he had convinced to open up shop in Brick.

"I have long-standing relationships with these people," said Toth. "I actually told them to look at Toms River and Brick."

In the case of Joe Canal's, he said, state liquor laws require business owners to pay suppliers within 30 days, and the owner of the store could have been "up a creek" if he could not open his doors and start selling his wares by the time the bills were due.

"The mayor can say anything he wanted about me, he's entitled to that," Toth said."

"We help them solve problems, and I'm guilty of it," said Toth. "I'm guilty of helping people."

Question, If Toth abstained from voting on liquor application and what not because he has a financial conflict as in that store could be his client. Can he ask other officials in town to expedite the process, yes or no?

It is my understanding that if you abstain for a vote due to the fact you may have a financial interest or conflict. You cannot have any involvement in the process. Mr Toth will not state if these folk's he asked for help with are indeed his clients. Did he abstain from voting on the same places he asked Mr Bellu for help on?

Simply put, It's a Disgrace! Obviously, there was a reason or a host of reasons as to why his client had not obtained his Certificate of Occupancy. It is inexcusable that a Councilman was using his position to sidestep the process that ordinary folk have to abide by. There is a significant difference in intervening on behalf of a Client in which you have a financial gain and helping the average Citizen who has no family or profesisonal affiliation.

This is easy. Danny are the folks you asked help with your clients? Did you abstain from the same deal's you asked help with? If you abstained, then as sure as heck you cannot ask for help with thru town on the same app's. Just come clean either way.

If Toth has any of those liquor stores as clients that he abstained from , AND sent a letter to Juam Ballyhoo to "expedite" anything then he's up a creek not the liquor store. He cannot have any financial interest if he abstains, whats the beef here.

It is my understanding that Councilman Toth abstained from a vote for his Client at the Council Meeting. It is my belief that he crossed the line and boundaries set by the Rule of Law. It is imperative that our Governing Body conduct itself in a proper manner and avoid conflict of interest and financial gain under the guise of assisting one's friends . An investigation into this matter is warranted. On another note, I am disturbed and sickened by the Administrantion and the Councils' inability to act judicicously and equitably on behalf of its Citizens. The continual conflicting statements on each and every matter where "POWER" comes into Play needs to end now. Someone needs to step up to the plate and demonstrate that Consensus Building is key. Enough is Enough. Kudos to Councilman Moore for considering the People's needs first.

Forget this banter. Unite and do away with local govt. Have a county system. Our govt counts on us being unorganized so they can push through their agenda (think Acropolis robo calling the seniors and no one else to get his tax program through or spending our future on a park that will compete with local businesses) How do you, reader, feel about this concept? Thoughts??

Correct if they are NOT his clients and he did NOT abstain from the vote. If he requested help for one of his clients and or abstained from voting and then asked for help that is illegal, period. What is it that you frienda and family of Mr Toth do not understand

Thats funny! Knucky Johnson from Boardwalk Empire. We need a little laugh after last weeks fiasco. It did not take long for the Dems and Mr Ducey to turn the council meeting's into a clown fest. But then look who is on council, Lydydecker, Fozman, Tom Dooley, I meam Ducey? No wonder they get laughed at around town. Toth thats a whole different story, I feel sorry for him now. He looked like he wanted to cry at the end of last weeks meeting after he started to figure out what he had done.

Toth grandstanding for a issue that doesn't mean nothing to help bricktown..Frenchmens land waste of time and money solar thats going to cost us money ,budget out of control ,siding with dem;s when they pushed to do illegal change of township supervisors postions and to get a old member dem council to a position that wasnt needed..sounds like he's trying to change things for the worst..We need change not smoke and mirrors come on folks open your eyes..they are doing what they want to help to get dem's in postions no savings there ..It will cost Brick more in the whole and its illegal .legal battles to come and we will lose ..more money ..

The "clown fest" was perpetuated by the childish behavior of the Mayor. You would think that by now he would be a little more seasoned in the public arena. He does well when everyone is on the same page with him. Any disagreement or adversity and he flips out. Maybe he should bag it because he only has one year left and it doesn't appear to be the easy street it was when the Council was all his pals. The stress is not worth it, or is it?

Denny, Sorry after watching the tape and seeing "im in charge here" Double Ducey Doo yelp like a child. All I can think is it did not take long for the Dem's to make arses out of themselves. With the lead arse Toth and his "expediting" of his clients business. Pleeze give it a rest. Not only was it a like watching a bad sitcom. It made the new council president look like he took lessons from my 4 year old. I think Duckey should really go to the mat with Tooth and find out if he asked for help for HIS clients.

Bravo to Councilman Moore for voting as a responsible Councilman representative of ALL THE PEOPLE in a fashion consistent with sound judgment and loyalty to his constituents, not his party. In my opinion, Councilman Toth acted in his own best interest and his actions are worthy of further investigation.

I found it amazing last night that so many of our elected officials are ignorant of the procedures and practices of our government. The township attorney has to be present to tell them how their actions determine outcomes. Councilman Toth's abstinence essentially became a NO vote because he provided an explanation as to why he abstained? How was this objective? If he did not give a reason, according to Atty Cipriani, the results would have been different and a super majority would have been reached.
