Taxi Company Still Operating After Filing Suit

New Mantoloking Taxi is still operating more than a week after its license technically expired.

The Brick Township council declined to renew the company's license to operate taxicabs from its Brick headquarters last month, citing years of legal wrangling stemming from the company's noncompliance with a number of township zoning laws.

The company has also had a stressed relationship with residents on neighboring streets.

The company's taxicab licenses expired Oct. 1, but it is still operating after it filed suit against the township, Mayor Stephen C. Acropolis confirmed Monday.

Acropolis said the case would now move into a mediation phase and can continue to operate while the legal process moves forward. He criticized council members for going against Township Attorney Jean Cipriani's advice to grant the company a short extension to comply with zoning laws, then hold a hearing to determine whether or not the license should be renewed.

The council voted unanimously at its Sept. 25 meeting against renewing the license.

Township officials said at the time that the company had failed to obtain a zoning permit and was operating vehicles other than taxis – specifically, medical transport vehicles – from the location. The company was recently in a battle with the township after it paved over a residential lot and parked vehicles there without having been granted a variance from the Board of Adjustment to be able to use the lot for a commercial purpose.

The paving has been removed following a decision by the board in July formally denying that variance.

New Mantoloking's owner, Henry Acierno, was not available Monday, a person who answered the company's phone said.

Recently, the company's Mantoloking Road site was put up for sale with an asking price of $220,000.

New Mantoloking's attorney, John Ambrosio of Montclair, said last month that the company was in the process of negotiating a lease for a new property in Brick or Toms River.

Fine them every day they operate without a license. If the fine is big enough it will cover the towns legal costs.

what is the big deal....they are a commercial transportation establishment, they are in a commercial area, why is this town running them out....good god we need less government...

Agreed.... I have never used the service, But it seems to me that the neighbors do not like the type of people that use the service or that work there, the biggest issue to the public was where the employees parked their cars. The neighbors didn't want them parking on the street .. so the black top the back of the building... Well,, that was a problem too, From a neutral party .. they really seemed to be a target & getting picked on by the town. Maybe thats the way Brick township works ... if the do not like the element of people that work or patron at a establishment they just do everything they can until they leave( Red lion also...)

Get a life! Ever hear of OVER USE? They outgrew their site because of their popular business. When that happens, they either expand their property or get a larger conforming site or scale back their growth. It's nothing new. We have had many businesses who opted to grow within the regulations without causing safety, enviornmental, or estetic problems.

So if its a business that being used so much ( I bet it will increase as People are unable to keep a car on the road & .or pay at least 5$ a gallon of gas) even n more people will need it. Why have them chased out? Why Give them a hard time about blacktopping a parking lot for them to park on ? Why complain about parking on a PUBLIC street? That would be like the residence of Belmar( or any beach town) not wanting people to park along the streets in front of their homes in the summer ... SO the town would put resident only parking... Its just seems ridiculous to me that so much time, energy & money is being spent on this issue.

Disagree with Acropolis and Cipriani... The best thing was to force their hand via litigation... therefore get a Judge to rule and expedite the matter... this has been going on for at least 2 years now.

We are running them out because they are not a liquor store. Maybe when the cab company is booted we can put a liquor store there. I don't think there are any in at least a quarter mile.

Its gettin more difficult by the minute to run a business in NJ. These little companies are being swatted away by bureaucracy. They can't get a break

This place needs to leave and take their trashy buisness to some other town. They break the law,think they can do what they want,their cars,vans and building look terrible. Their drivers drive all over the road,speed,run red lights,cut in front of you while they try to change as many lanes at one time. Take this dump of a buisness and get it out of Brick.

While the majority of these negative comments are from the past employees and from the people who live on Manchester Ave., it is great to see that the rest of the community recognizes that New Mantoloking Taxi is a great company. Their customers obviously are very loyal and felt the need to take their time to vote New Mantoloking Taxi as one the best transportation companies in Ocean County. Way to go guys!!
