Retail Sale of Dogs, Cats Now Banned in Brick

Current stores will still be able to operate, however

Joining only a few municipalities nationwide to ban the retail sale of dogs and cats, the Brick Township council voted unanimously Tuesday night to pass an ordinance outlawing the practice.

The new ordinance bans businesses from selling, delivering, offering for sale, bartering or auctioning cats or dogs. It does, however, grandfather in current businesses that operate legally.

The new law covers both pet stores as well as businesses that register as kennels.

In Brick, just one such business exists: Breeders Association of America, Inc., on Route 70. The store, registered as a kennel, has been the subject of protests by animal rights activists who accuse the store of selling puppies from so-called "puppy mills."

Attempts by Brick Patch to interview the owner of the store have been met without a response.

But Breeders Association will be the last of its kind in Brick, thanks to the new law, officials said.

"We have one in existence. Let's keep it like that," said Councilman Dan Toth.

Councilman Domenick Brando said the process of developing the ordinance was "eye-opening" for him, and generated e-mails from as far away as Europe.

"I'm sure, down the road, this council or other councils will have to tweak things, but I think we have it right," Brando said.

The purpose of banning the retail sale of dogs and cats is to encourage those seeking a pet to adopt from a shelter or to purchase an animal from a reputable breeder. According to the Humane Society of the United States, retail stores often sell dogs and cats raised in so-called "puppy mills" and "kitten mills," where animals are kept in poor conditions and bred improperly, leading to lifelong health and behavioral issues.

Under state law, municipalities have the authority to regulate the existence of stores that sell animals, which set the legal basis for the township to act on the matter.

"I have prosecuted some dog cases in the past, so it's something I've had some experience with," said Council President John Ducey, who has worked as a municipal prosecutor. "It's something that's a very important issue … those who cannot speak for themselves."

The idea of banning the retail sale of dogs and cats in town was precipitated after one puppy store in town, Puppies Galore, was in January. The store had been the recipient of multiple health code violations due to poor conditions, and 26 out of 39 puppies at the store were found to be sick when they were removed the day the store was shut down.

The store's owner and manager were both charged criminally with animal cruelty. Their trial is expected to begin Tuesday in Brick municipal court.

Violating the new ordinance in Brick could earn an offender a fine of up to $2,000 and 90 days in the Ocean County Jail.

Hey coffee wrong wrong wrong. A retired person with no expenses except food and utilities, who has an income of over 2k per month CAN AFFORD TO LOVE A PET. A child is NOT a danger to the animal, I have had dogs and cats ALL my life and not once did myself or my 4 other siblings endanger a pet. My children have had dogs and cats all their lives, never once was a an animal in danger.
Angry?? Nope, I thought I would be doing a good thing by going to the shelter and rescuing an animal, but I was wrong, they want donation but they do not want to adopt out the animals. So I did like everyone else did, and went to a pet shop and bought a dog. I took my mom to petsmart an she adopted a beautiful 2 year old cat. So my friend, that is 2 animals who are stuck in a cage 24/7 because the people at the shelter didnt want to adopt out an animal under their rediculous rules. WHY DO YOU THINK SHELTERS ARE OVER FLOWING? IT IS BECAUSE THE SHELTERS WONT LET PEOPLE ADOPT. Now you have a good day, and say a prayer for all those animals sitting in over crowded cages at the shelter

Adopt a greyhound! Greyhound friends of NJ had me complete an online application, they did a phone screen, and then we went to an open house adoption. We got our dog on a Sunday, and she had just come up from the track on Friday. She is the most wonderful, sweetest dog imaginable. They are not highstrung, or need a huge amount of exercise.

My husband and I adopted our first cat from Jersey Shore 13 years ago. We were newlyweds who both worked and lived in an apartment. There was no visit or interrogation; you simply fill out the adoption form and they let you know within 48 hours if you are approved. Same thing for the kitten we adopted from Monmouth County SPCA last year, with an additonal quick reference call to our vet. Several of my family members have also adopted a number of dogs from Jersey Shore with no problems. If you do not have the time for a chat and some paperwork, then you surely do not have the time it takes to properly care for any pet.

Yes greyhounds are wonderful and I tried to adopt one years ago. The problem with greyhounds is if you open your door they can run outside. Then try running after it when they are running at 40mph. Gone in a blink of an eye. They are trained to race and we the human are not. They refused me but I totally understood.

Jersey Shore Animal Shelter refuses many people for no true legit reason. The refusal reason they gave me was, my deceased dog was never nutered (never sired a litter didn't matter) and I used Petco for my shots (according to them their not a real vet) According to the Jersey Shore Animal Center website the dog I tried to adopt in October Fuzzy is still a prisoner there in a 8X10 cage. When I put in the application I was told then that 50 people already put in applications and were turned down....So where is the humane in that building???????

Danno -- Puppies Galore had only been open a few months before they were under investigation and eventually shut down. The animal control people and O.C. Health Department actually acted pretty quickly on it.

Hollowman -- Nope, the rescues that partner with PetsMart can still do so. This is only retail sales of dogs and cats, so adoptions of dogs/cats and the sale of fish, birds, reptiles, etc. aren't banned.

If you bought your dog from Breeders Assoc. or any other pet store, your dog is without a doubt a puppy mill dog. There are no GOOD puppy mills, and there are no GOOD puppy stores. Just because you beat the odds doesn't make it OK. There is not a single reputable breeder in the world who would sell their puppies through a pet store. Not one.

@BW its sounds like your a bitter person. maybe THATS why they didnt want you to have one of there pets. I adopted a cat there about 2 years ago, Noone came to my house to inspect it, Noone has come to check up on the animal. it was a simple app. to fill out & if that was to much work for you, then you really SHOULDNT have a pet, ( Pets are alot more work then filling out a piece of paper with basic info on it) I dont know what you are talking about in crowded cages, the dogs are walked 3x a day outside ( my teenage daughter worked/volunteered there last summer & the cats are in a opened room.... Please know the facts before writing something.. & good luck with your retail pet.

BINGO.... that's why you were able to adopt so easily from these nut-jobs. BW and the many others is just telling the truth about Jersey Shore Animal Shelter. It is what it is. What's a real shame is that most or all of the puppies that were seized from Puppy's Galore went there. The pup's went from a house of horrors to be condemded to an unreasonable wait for a good home.

Would you please let the readers know exactly what research you did to prove that your puppy bought from Breeder's Association did not come from a puppy mill? Did you call the breeder? Did you research the USDA records on their website which would have allowed you to view their inspection reports? Perhaps you took the sales people at their word when they told you that "Their dogs never come from puppy mills" and that was proof enough for you? Provide the breeder name and address on this blog and I will look up your puppy's breeder. You can then decide if your dog came from a small, reputable breeder. UGH!!!

I understand the frustration with taxes and spending. My daughter and her husband live in Brick and their taxes have risen a huge amount in four years and they are a young couple. We still are very involved in the pet store issue because we know the connection between pet stores and mass commercial breeding facilities. It is ugly and someone has to speak on the animal's behalf. In the meantime, let's hope Brick does something to alleviate the financial hardship of their residents.

Our research has not found a dog yet that has not come from one of the seven notorious puppy mill states: Missouri, Oklahoma, Ohio, and Iowa. If their breeders were so special, they would be local and not MASS breeding puppies. The more puppies they churn out, the cheaper they are and the more these pet stores make profit. Mark up is astronomical. It is criminal. A reputable breeder does not MASS breed. Only pet store suppliers MASS breed. Thanks for your wise comments.

@ So much to say... READ WHAT THEY WROTE IDIOT... THEY WROTE THEY ADOTED THE CAT 2 YEARS AGO & THE DAUGHTER WORKED THERE LAST SUMMMER... ( must be Brick educated)
I also adoted a kitten .. & then later a cat there it was very simple... ( maybe diffuclt for some I understand) It was a matter of filling out some personal basic info... The dogs are well taken care of & are walked by teenagers & seniors threw out the day The cats generally are not in cages they are usally in a large opened temp controlled room with toys food & water... From I have seen, are taken care of MUCH better then some pet owners... Its not just the paper work they look at, its the charactor of a person that they look at, which explains why some of you where denied Adopted a pet from a animal shelter ... Might want to think about that before letting the public know YOU where Denied a homeless animal...

The people running Puppies Galore had been under investigation for along time by alot of people. They just closed up shop and moved to a new town whenever things got hot. They had just been run out of point before they opened in Brick. That's why it seemed so fast but in actuality had been going on for a long long time.
As for this store yeah they get them from puppy mills.

Way to go Brick Township! Hopefully this decision paves the way for other towns to do the same.
And to those who mentioned that Breeders Association of America in Brick is a reputable store and that you got a healthy puppy from there, please look at the two links below. The problem is not with the condition of the pet stores, but the conditions in the mass commercial breeding facilities (puppy mills) from which these puppies come. Breeders does in fact buy their dogs from inhumane breeding facilities like these, and the USDA records prove this. yeah I hate to say it because I know the mean well but Jersey Shore is notorious even among people involed with the rescue orgs for being over the top with their requirements. The Monmouth SPCA is much better.

Now maybe someone will take a look at them & see the cruelty that these animals endure just so someone can make $$$$$. Now if only other towns across the state & nationwide would do the same thing!!! Why do so many people jump on the band wagon when there is a threat to animals and or sports programs in this town? If the board of ED were to ask for a new school you all would whine and complain but cruelty to animals (which is horrendous) or cut a sports program and all you bed bugs come out!

personally Mrgrunpass, I have 3 teenagers & my taxes go up ANYWAY every year, I would totally support of a new school ( have ya' been in Brick High lately?? totally fallling apart) SINFUL that the other side of town has had up keep down, some remodeling & that school was build in the 80's while old brick was build in early 60's & NOTHING has been done.( including sinks not working in the bathrooms &very limited hanicap assp. bathrooms).. I vote for the budget every year, but REALLY makes me wonder how the $$ is spend & it makes it harder & harder every yr to vote for it when I hear the salaries that some are making ( not the teachers that SHOULD be making the $$) & Nothing being done to the schools upkeep SHAME on them, NOt sure how some PPL sleep at night ( & BTW also adopted a cat at JS animal shelter) he's totally healthy, & was NOT BIG DEAL ast all to adopt him, NOT sure why PPL where complaining over that...

One thing has nothing to do with the other. The point is that people (you and many Brick residents) have purchased sick dogs from Breeders Association and have spent thousands of dollars on vet bills because of this business owner's greed. Brick Veterinary is my vet and they are furious with this place and have seen many sick animals from them. Talk to the people that have been protesting!!!!!

With regard to Bob Murath's comment: Until you see one of these places, Bob, you wouldn't believe that your puppy came from one. But indeed I live in SWMissouri and have seen over and over again the example of such places. I attend Dog Auctions here in Missouri where these breeders just breed the heck out of dogs. If you bought a pup from a puppy store, you can best believe it came from a Mill. In order to fill those empty bins in the store, they have to keep pumping out the pups. It is a horrible place, and with so many other animals that are needing homes, why would you even consider buying a puppy from a store? 80 percent of all dogs in a shelter are purebreds that their owners had to relinquish. If you want a puppy YOU NEED TO GO TO THE BREEDER FACILITY and check out what condition the breeder dog is in; the living conditions before you contribute to the breeders way of life; and make sure that the breeder has vetted the pup (that the pup has actually seen a vet and not just been given shots on their own). And DON'T BUY OVER THE INTERNET. That is so risky. Always go to the facility!

In case any of you are interested you can adopt animals from an organization called S.A.V.E. our headquarters is on Fisher Blvd in Toms River and we're also in Pet Smart in Brick. You can fill out an adoption forum online or at one of those locations. The adoption days are on Saturday and Sunday mornings as well as Wednesday evenings at Pet Smart. I just started volunteering for S.A.V.E. so I don't know everything.

Thank you Brick Counsil Township for taking a giant step toward helping to end the horrific cruelty taking place in commercial puppy mills, I Pray the rest of the world will follow in your foot steps. All the people singing the praises of the puppies they purchased from these stores consider yourselves very lucky, I can assure you they also have many horror stories as well. Don't be fooled by the BS you will get from the pet stores, reputable breeders do not commercially retail animals because they care about the welfare of the puppies as well as their breeding dogs. All pet store puppies, as well as puppies sold over the internet, at flea markets, from the backs of cars in parking lots etc. come directly from puppy mills or unlicensed backyard breeders. Ask the pet store for the name and location of the breeder as well as the broker who purchased the puppies from the mill, than check the USDA report and you will find out the truth. Please people do your homework and Google puppy mills before you moan about a deed that should be commended. I can guarantee you that people who would have compassion for these suffering animals will definitely do great things for your town. You are truly blessed, just wait and see!
