Two Brick Residents Arrested in Wall

Pair were found to have outstanding warrants, police said

 

Two Brick residents were arrested on outstanding warrants overnight, Wall police said.

Susan Levash, 43, and Thomas Levash, 37, both of Brick were arrested around 11:49 p.m. Monday while crossing the  South Wall Interchange, a place that does normally not have pedestrian traffic, Sgt. Heath Bono said.

Susan Levash ran when officers arrived, but was caught a few hundred yards away, Bono said.  She was taken to Momouth County jail, Freehold Township, after being arrested on an outstanding warrant from the Monmouth County Sherriff’s Department. She was also charged with providing false information, Bono said.

Thomas Levash was turned over to Point Pleasant Borough Police when officers found he was wanted on warrants from that department, Bono said.

I wonder why the police made contact with them, was it simply for walking?
I am pro police however it makes you wonder how walking in a location no one normally walks allows the police to stop you (and one could debate, how it is judged that no one normally walks there)....Is this not the land of the free?

Ironic how these types of police encounters are tolerated however if you ask a person if they are a US citizen all hell breaks loose......

The article is brief, however, you have one perspective and I have a different one. It states that Susan Levash ran when the police arrived in an area not known for pedestrian crossing. It's midnight and someone is crossing a major roadway. Sure it's the land of the free, but that doesn't mean that such behavior doesn't raise a red flag to police. Then, when the police pull up to the woman, she takes off running - that raises a second red flag and we don't even know if the police were aware previously of the outstanding warrants for the two....

They probably just didn't look right to the cop. He obviously had a good eye and knows what to look for. Kudos to him. That's what we pay them to do. The cops keep these folks out of our neighberhoods, we just don't realize it. Do your job, let them do theirs, and shut up. You folks are clueless.

I wouldn't say clueless, I would say more just thinking about the Constitution and where you draw the line. People walking are fair game however, if you pull someone over an ask them if they are a US citizen you are wrong. My point is more to the ironic nature of the scenario, like I said I am pro police. However I have concerns when the law is based on "people just don't look right". There's an ad for an insurance company where the guy has all tattoos all over his body and is wearing jeans and a leather vest... the title says don't judge me by my looks....next page he is in hospital scrubs and he's a neurosurgeon...

He must have had a reason to stop them. They probably looked high as kites or were otherwise visually suspicious. Good for him for doing his job and to the people on here who are throwing the constitution into the mix.....I have no problem if a cop stops me any given day, because I am not breaking the law. I'd rather them stop suspicious people and check into it....no harm done if they checked out ok and went on their way.

you all missed the major fact here - it took place at 11:49 PM. You have two people in a place people are not normally there and then its at 1149 at night. put the facts together and its a suspicious condition that needs to be followed up by the officer. If they were walking around your neighborhood at that time of night I guess you would want the police to stop them and check them out.

perhaps this article is not written with all the facts. Either way it was a good stop by the cop. Now only if we could get Hollowman to not be afraid of doing the same thing in Sawmill then maybe Brick can start to clean things up.

You're bordering on obsession my friend. And for the record I never said I, or any other officers, do not or should not go into sawmill at all, you are putting words in my mouth. I am in there quite regularly, make arrests in there quite often, and in no way shape or form have any problem sitting in there checking out the neighborhood. You are acting like an infant over the fact i stated I dont believe officers should sit anywhere that could put them in harms way while they are distracted. Thats all. Why do you insist on twisting facts to make yourself seem like some tough guy? Do you really need this much validation from a website that you feel the need to continue to hash up your hurt little feelings of disagreement from one short lived instance in your life? Give it a rest.

You seem to intentionally overlook the most important aspect of that prior disagreement, which was the "while they are distracted" part. I can only guess at why you choose to ignore that part of my prior statements, probably because it invalidates your argument entirely but that is just a guess. For the most part I agree with all of your posts that I see you comment on, with the exception of the ones where you feel the urge to act like an immature little baby and harass people you disagree with. You are aware it is possible to disagree with someone and still remain somewhat civil and mature, right?

I agree WMS826 we need a few of these motivated policemen patrolling Sawmill. I see numerous suspicious characters walking around in there. I wonder what they would find if stopped? They can start with the one who walks around in there wearing gang members Bloods red. God I hope the cops realize thats why he wears red.

Well glad I don't live in wall, I look a little crazy walking my dog sometimes at the crack of dawn.... I'd be suspicious of me the way I look. I guess I'll have to make sure I have full makeup & hair done & " look" right if i'm ever out after midnight

As far as in what way are the police allowed to stop someone they deem suspicious there are a few scenarios.. According to established case law by the US Supreme Court Cady v. Dombrowski police can perform a community care-taking function in which they are not actively investigating any criminal activity for example: Two people are walking down the side of the roadway where there are no business' and no residential area. It is reasonable to believe they may be in need of assistance due to a disabled motor vehicle, giving the officer reason to check on their well being. Another case law is Ohio V Terry, which states police can detain someone if they reasonably believe a person has or is about to commit a crime. If the arresting officer was first performing a community care-taking function, to simply check on the well being of two pedestrians in an unpopulated area with no residences or business, something he claims is unusual, and then one of those pedestrians flee's on foot as he arrives that would elevate it to a Terry Stop, giving the officer reason to further question their identities and discover the two outstanding warrants.

If you are a representation of our police force then god help us all in Brick!. Quit over thinking and quit trying to be a law professor to an internet blog.

It is not illeagal for a police office to walk up to someone and talk to them. If someone was standing on the corner of Sawmill and a brave police officer, if we have any brave enough to enter there alone, stopped and asked them questions there is nothing wrong in doing so. Nothing wrong with this as long as the person is free to leave. I have on many occasions questioned people in this circumstance and have found other criminal wrong doing. This is their choice to stay and answer your questions, once they cannot leave the game changes. Asking them their name and what they are doing here is not detaining them.

We need motivated policemen out there who will stop and ask people standing on the corner of a known drug area what are you doing here. If there is no good reason then stand next to them until they leave. Perhaps you belong more in a classroom, those who can't do, teach it is often said.

The only big talker I see on here is you, WMS. Again the only thing I posted in here were details people were asking about. I don't feel people want to hear the excuse "cops do [this] because they are allowed to." People would much rather hear WHY in a legal sense, and at what precedence, police CAN do the things they do. I'm also confident that people are comforted by the fact they have a police dept where it's officers are aware of the laws and rules that they must follow, and not simply do things because they are told to without understanding its reasoning.

And no, most of the time people who use big words are simply educated people. It's a shame you some how have grown up to associate things like big words, proper writing skills, and intellectual capability with some lower form of social class.

If I was on here to cover up short comings, or to somehow make myself appear more than I am, wouldn't I use my real name as opposed to an alias so people would associate these writings with a real person? Fact of the matter is, I only come on here to provide a source of information most people don't have access to, as I feel its an important aspect to many of these stories that is left out. I don't provide my name as I don't need asshats like yourself showing up at my door or slashing my car tires. However, if you'd like to meet in person and discuss my work ethics face to face, feel free to leave your email address or real name. Otherwise, you're just a blow hard.

So..we caused this much drama. Let me clarify. Dropped offs enterprise car rental at 8:40pm and crossed at 70 and 35. Officer rolled up and did tell. LLC us couldn't be walking that highway.WORD? Only due to a missed court date warrants issued..not a couple of degenerates. Though. Had much to do following day. By the time all said and done was almost midnight. Explanation. Cause his? ? Was rediculous. But had all been clear we could've. Likely. Got a ride back 2 temporary. Stay instead of jail. Lol YA KNOW. NO NEED 2 WORRY ABOUT YOYR HOOD. Truly hub and I r harmless. SL
