The Ocean County Sheriff's Department arrested two Brick residents during the month of September, officials reported on Tuesday.
Countywide, the agency arrested 82 people, including nine who were wanted for child support arrears totaling $100,892.
Those arrested from Brick were:
- 9/5/12 – James A. White, age 41, of Rose Manor Court was arrested by Sheriff’s Detectives/Deputy US Marshals T. Duffy and R. Trainor on a Mercer County Superior Court Warrant for failure to appear for a intake conference original charges of aggravated assault with serious bodily injury. White was processed and lodged in the Ocean County Jail with no option of bail.
- 9/24/12 – Samuel Patriaco, 24, of Primrose Place was arrested by Sheriff’s Detectives R. Stark and M. Petrucelli on a Superior Court Warrant for failure to comply with the Intensive Supervision Program. Patriaco was processed and lodged in the Ocean County Jail with no option of bail.

Wonder how many of these people have been arrested for refusing to pay or are they unable to pay due to loss of income? There are situations where probate is involved and the party is in arrears because the garnishment is divided between child support and alimony. Being in arrears for child support is punishable by jail. Being in arrears for alimony is not. Probate does not fairly apply the garnishment to satisfy child support first and whatever is left over to alimony second. It is a back-handed way to imprison people for 'failure to pay' as opposed to inability to pay. If it is true that they have reneged on their obligation to their children, then that is the consequence. If they are unable to meet the financial obligation of child support because of loss of wage and simply do not have the income accessible to do so, then placing them in jail does little to remedy an out of hand situation. If the courts have unfairly divvied up child support / alimony leaving the child support short, then that is a problem that needs attention. njalimonyreform.org
