Suspected Drunk Driver Facing Additional Charges

Bryan Vanderburgh now faces criminal charges related to May 3 accident

 

The driver of the vehicle who police say caused an accident that resulted in injuries to four people was charged criminally Friday.

Police say Bryan Vanderburgh, 27, was drunk when he ran a red light at the intersection of routes 70 and 88 early Thursday morning, crashing into another vehicle and damaging a third.

Vanderburgh was charged Friday with three counts of aggravated assault with an automobile, Brick Police Capt. John Rein said.

The charges, Rein said, are the result of an ongoing investigation into the 1:49 a.m. accident and based on the fact that the investigation showed Vanderburgh was intoxicated at the time of the crash, as well as the severity of the injuries suffered by three of the accident victims.

Police say Vanderburgh was driving a 2012 Nisssan Frontier pickup and violated the red light signal as he was traveling eastbound on Route 70, approaching the Laurelton exchange. His vehicle struck a 1994 Acura Integra driven by Edwin Triana, 28, of Toms River, who was proceeding through the intersection on Route 88 in the westbound direction.

Triana sustained multiple fractures to his lower right leg and laceration to the back of his head. A passenger, Anthony G. Nieves, 25, of Jackson, sustained a head laceration and another passenger, Brian J. Unglert, 28, of Hoboken, suffered from a broken shoulder and a possible broken collarbone.

A third vehicle was damaged by flying debris, but its driver was not injured.

Vanderburgh was arrested at 3:30 p.m. Friday, Rein said. The criminal charges have been filed in addition to several motor vehicle offenses charged at the scene, which include DWI, reckless driving, careless driving, failure to observe a traffic signal and failure to wear a seatbelt.

Brick Municipal Court Judge Robert Lepore set bail at $30,000. A check of jail records early Saturday morning showed Vanderburgh was not being held at the Ocean County Jail.

It's amazing how the driver accepted two friend requests on Facebook at the same exact time the accident happoned, according to his Facebook. Maybe if he was paying attention while he was driving the accident would have been avoidable.

How could you even put any blame on the driver. He had the right away .. Green light, not speeding, SOBER!!!!!!! When this kid bryan was drunk, ran a red light at 70 mph probably in a 45 mph speed zone, not to mention this is his second dwi ... He should never be able to drive again and deserves to sit in jail for a very long time to think about what he did to these 3 innocent boys. And how do you know if the other people didn't accept his request that he could have sent days before the accident...

Doyle has not been criminally charged. The Grand Jury did not indite him...3rd DWI and a death and he was not indited. The Prosecutor presented the case as if he was on the side of the defense. The fact that there was THC in Doyle's system wasn't presented. His actual speed was also not represented. His connections in the "justice" system are bigger than Brick. He still hasn't been convicted in traffic court because he knows too many of the judges and they can't find someone to hear the case...hoping that one of the investigative news show grab hold of this atrocity and then watch how the cockroaches scatter....BTW, Doyle is still driving so we are all in danger.

This is great news!!!! He needs to rot in jail for the pain he caused to others.. He didn't just hit and injure 3 ppl he may have ruin there dreams and lifes completely. Those 3 men in the acura were not just ordinary men they were going places in life and making there dreams come ture. And because of a drunk ass playing on his phone it could all be ruined lock him away he didnt learn the first time injured 4 ppl the second are the police gonna give him a 3rd chance to kill someone next!!!!

Ever think he was at a red light and that when he picked up his cell ...in that case regardless if he was on his phone or not ,the only true way to avoid this accident was for the pos to have not driven drunk...what happens if it were u crossing that intersection would it be ur fault bc u just happened to be driving in the vicinity of a drunk.....maybe if more people actually severely punished the actual people at fault the FIRST TIME rather than place blame on the sober people just trying to get home to their families from work maybe our society would be a little better

The jokes you hear on TV and in movies about bad drivers, sadly enough is not a joke, but a solid understatement. When driving anywhere in New Jersey, you are guaranteed to see your life flash before your eyes many times. Just before death, your subconscious alerts you that you are about to die in New Jersey, ending your life flash, and making you pull off a near miracle just to stay alive a little longer. In the state of nj dwi is not a crime, its only a motor vehicle violation. If there is no record of him in the county then he probably was able to post the bail

Many arguments here. Blaming ALL NJ drivers is ridiculous. (The real story is why do people still drive drunk ? ) The penalties need to be greater and loss of licence longer as well. I had my 2nd DUI in 1992 and quit drinking that night and lost my driving priviledge for 2 yrs, sober almost 20 yrs now. 2 years, yup, I learned my lesson. Why do people still drive drunk ??? Your out of your mind if you do !!!

Congrats Greg! I know how hard that road is, having a family member who has now been sober for 7 years and 8 months.

And yes caught DUI even once, should be jail, fine and 5 years loss of license. Maybe we would have a lot less repeat offenders

Congratulations Greg i also have a family member who has 24 yearz sober and also a family member killed in a drunk driving accident but my family member was the drunk driver and unfortunately he payed the ulimite sarcerfice with his life. Its a tough road but N.J is to leanit on dwi this is the top killer in 12 and its sad.

Should be revoked of the privilage of driving, and since proven over and over he is no help to society- keep him away from those who are. There's a place for everyone in life- out on the field making it better, or in a cell rotting with the other wastes holding us back. Lock em up and pray for the victims. They are VICTIMS! @ gotti. He might have been on his phone but his eyes were on the road. The other guy was looking at his phone. Any way you want to spin it the guy is at fault not Edwin. And to try to spin it to make Edwin look like the bad guy while he is in the hospital is wrong on so many levels it's not even funny. The guy was drunk ad ran a red light, Edwin had a green light, therefore Edwin is not at fault. I do not know any of those guys in that car but i am hoping that they are all okay. Oh and if you haven't gotten the point the guy was a drunk driver and should rot in jail and you are an asshole for trying to point the finger at someone who is lying in a hospital bed bc someone didn't want to call a friend or spend the money for a cab instead of another drink at the bar.

It's a drunk driving accident, isn't the first & won't be the last. To say it was a cell phone is just someone looking for attention & it obviously worked. I know a 2nd DWI will earn you a loss of license for 2 years. Killing someone at your fault while under the influence will earn you 5 years in prison.

I will go ahead and set the over/under on Bryan's penalty at 2 years loss of license, community service & 2.5 years in prison.

PS, i'm at work leaving this comment, so i'm not an unemployed bum.

The penalties for assault by auto or vessel are very severe and can be as high as those for a 2nd degree crime which can be punishable by up to 10 years in jail. There are many different factors which come to play when charges are filed and sentences are determined for assault by auto or vessel, such as the extent of the injuries as well as the location that the alleged crime occurred

I have no sympathies for any person who is intoxicated and goes behind a wheel. Whoever got the idea of making alcohol and making it legal should go somewhere because assholes ABUSE it. Probably 75% of people might be drinking RESPONSIBLY but why do it anyway. This dude's lisence needs to be taken away for good. I may not know the 3 victims personally but I know they're goo people and don't mean harm to nobody. It's sad how innocent people get put in situations like this. One of my close friends that i have known since the 1st grade, got hit by a drink driver and my friend died within 2.5 seconds of the accident. I have no respect for this Vanderburgh kid because he put these people in danger because he wanted to be a dickhead and not learn from his first mistake. God does NOT like ugly but this kid is going to get what he deserves. And for the record, its not only NEW JERSEY that things happen; its all over the world. The state of NJ may have its faults but no state is better than any other state so whoever has a PROBLEM with the laws of NJ better keep their comments to themselves and get the TRUE facts. Anyway, my prayers go out to the 3 people who were injured.

He didn’t do any time in the county jail due to the fact that his parents are enablers. I’m sure they bailed there alcoholic son out of jail rather than letting him sit on the block and think about what he did. Not that it matters since Bryan usually doesn’t remember anything when he drinks. If I were with the police or an attorney for the three guys that got hurt I would be checking in on T.G.I.F Fridays in Brick. That is Bryans favorite hangout and they continue to serve him regardless of how intoxicated he is. And given the direction traveled the smart money says thats where he was coming from.
