Ritacco Sentenced to More Than 11 Years in Prison

Disgraced former Toms River superintendent immediately taken into custody by U.S. Marshals

 

TRENTON, NJ -- Calling it the "worst case of public corruption he has ever seen," a federal judge sentenced the disgraced former superintendent of Toms River Regional, Michael J. Ritacco, to 135 months – just over 11 years – in prison.

Ritacco was sentenced by federal Judge Joel Pisano in Trenton today as his family members, seated in the court room, wept as their relative's fate was decided.

Ritacco must serve 85 percent of his sentence before being released. A restitution hearing will be scheduled in federal court later this year.

Ritacco voluntarily surrendered to U.S. Marshals in the court building, and remained stoic as he was escorted from the court room. His children could be seen in tears as he left.

"This is the worst case of public corruption I’ve ever seen," Pisano said. Other cases of public corruption are "nickels and dimes compared to this."

Pisano sentenced Ritacco to 135 months on the first count of an indictment, and 60 months on the 19th count. He ruled the sentences will run concurrently.

Ritacco pleaded guity April 5 to two of the 27 charges he was facing, and admitted his role in years of corruption at the school district, where as much as $2.5 million in bribes were allegedly passed between Ritacco, insurance brokers and intermediaries.

The superseding indictment alleged Ritacco, as well as former district insurance broker Francis X. Gartland, agreed to inflate contracts in exchange for kickbacks over years through 2010 at Toms River Regional.

As a trial date approached in spring and facing 27 charges, Ritacco pleaded guilty to two counts: mail fraud and conspiracy to impede the IRS. Ritacco could have faced 11 to 14 years jail time, according to sentencing guidelines.

As part of the plea Ritacco will forfeit $1 million dollars, his 2010 Mercedes E550, and $8,960 from his home found as part of an FBI raid.

Judge, Prosecutor Put Blame on Ritacco

Pisano, in his remarks, said Ritacco helped weave a complex scheme with the help of "professional thieves" — his co-conspirators Francis Gartland, Frank Cotroneo and Frank D'Alonzo.

"This was a complex kickback and bribery scheme which represents to me a shocking plundering of the public coffers," Pisano said. "This amount of money and this amount of time and the way you did it represent the ransack of Toms River."

While Pisano thanked the defense for its show of support, he said he disagreed with the representation of Ritacco as a "good man."

"It cannot be a good guy who did something bad and made a bad decision," said the judge. "Ritacco orchestrated this fraud scheme… for the purpose of fleecing the public coffers."

Assistant Prosecutor Dustin Chao said the Ritacco case was one of widespread greed. He said Ritacco was a main orchestrator, not a pawn in insurance brokers' influence. Chao said Ritacco had keen knowledge of how to best hide and funnel payments.

"He knew it was ripe for the picking," Chao said. "With his financial background and financial acumen, as outlined in this bound volume by the defense, he understood the cash cow."

Chao said Ritacco lived lavishly on the money he stole and hid, buying tens of thousands of dollars in jewelry for himself, his spouse and girlfriends.

"We are talking about $100,000 per year in cash," Chao said. "There's also almost half a million in cash unexplained for in that period...This became a full time job for Mr. Ritacco."

Chao was recommending 135-169 months sentence, saying it "is a fair and just sentence."

Ritacco: "All the things I've loved, are gone."

Ritacco made a tearful plea on his behalf, saying he devastated his family and the community by his decisions.

"Obviously I feel pretty awful about conditions and circumstances I created. It impacted my family, friends, colleagues and of course the school district I loved and served," Ritacco said, often moving his hands from his pockets, to rubbing his forehead, to tearing up as he spoke. "I am truly sorry, really sorry for the pain I caused."

Ritacco said he went from a respected man to one reviled, thanks to his actions.

"I was a guy who was respected in the community, by parents, community leaders. I’m the guy who destroyed it all," he said. "Children and families look to you for leadership and trust; I let them all down...When I was a teacher, I lead by example. Now when they look at you, they’ll see what you shouldn’t do."

Ritacco continued: "All the things I've loved, are gone."

Defense presents supporters

Pisano said he received 140 letters as presented by the government, the defense, and unsolicited from the public.

“This case has apparently generated some public interest, and I received, unsolicited, a number of letters from citizens, most of whom are from the area in and around Toms River,” Pisano said. “I can tell you, some of them are supportive of Mr. Ritacco and some are not supportive of Mr. Ritacco.”

After hearing about 10 minutes of discussion, Pisano asked Ritacco Attorney Jerome A. Ballaratto directly what he believed Ritacco's sentence should be.

Ballaratto said given Ritacco's age, suggesting he had 10 years of life left, and considering his impact on the community, Ballaratto suggested a 60-month sentence.

Ritacco's attorney said he asked his client, "What were you thinking?"

"I said, 'what are you thinking, how in the world is this happening...You have the adoration of the community, you have all the money you need...'" Ballaratto told Pisano. He said Ritacco told him "You’re gonna have to ask the other Mike. I don’t know where that guy is, I can’t find him in my soul, I can’t explain it. All I know is that I’m glad he’s gone. I know I will never let him in my soul, my heart and my being ever again."

Ballaratto said Ritacco's answer was heartfelt. "I really felt it was an honest explanation I recieved," he said.

Dave Campo, current defensive coordinator and secondary coach for the University of Kansas, was among several supporters who spoke on behalf of Ritacco. Supporters included longtime friends and colleagues, New Jersey Department of Community Affairs and Department of Energy Leonard Coleman, Walnut School Principal Kevin Smith — who praised Ritacco's creation of a day care — his son and others.

"We've been friends for more than 40 years," Campo said. "He’s made mistakes obviously...I feel he’s given most of his life to his family, his friends and the community... I know, I believe that his heart is heavy."

Impacts since 2010

The shocking arrest of the leader of the state's fourth largest school district, who in his 18 years as superintendent also for a time held the position of business administrator, came in October 2010.

The saga began earlier that year, when a raid on his Seaside Park home led to a fall indictment. Ritacco retired the same day of his arrest and went on to demand a payout of his unused sick time and deferred compensation from the district. The lawsuit for his unused benefits was later dropped after Ritacco entered his guilty plea to two of the criminal charges.

The conspiracy, school officials said previously, did not affect the quality of education at Toms River or impact teachers' ability to continue lessons, but it did change how the district does business.

Business Administrator Bill Doering and Superintendent Frank Roselli said previously that "great strides" were made to the administering of contracts at Toms River Regional:

"We have insurance contracts in place, and they are carefully administered with close oversight. We have board policy requiring that insurances are competitively shopped. We have appointed new auditors, through a competitive public proposal process, as well as appointing new construction related professionals."

In addition to the scrutiny of insurance contracts, the consequences of the Ritacco saga also included calls for greater transparency from residents and new board members into district affairs. Several pushed for videotaped school board meetings to be aired on local channels, while others asked for personnel committees and more public documents accessible on the school district website.

I think the way pension works... they take away the years when it started....
So, if it went on for 10 year... and he has 35 years with the district... his pension is calculated based upon 25 years of service... That is my understanding of the law... but I'm not certain.
That is how they did Scarpelli with Brick to my knowledge.

As I understand it, no he will not. He is convicted of a crime and forfeits it.

I also hope he spends the next 10 years doing something to help others. That he doesn't waste his education. That if he is really sorry he will figure a way to help others even while he is away. I read this story about how the State of New Jersey pays a pension to a former head sheriff that admitted to molesting 8 boys and was caught in a sting with a 9th that was really an undercover State Trooper, yet he only did 9 months in county jail is not a registered sex offender and collects a pension from the state. I think we should demand a little light be shed on this pension issue and that the profits of this corruption be auctioned off with all proceeds to go to the board of education. This in no way compensates those shut out of jobs, or students who were taught by less than sterling pedagogy. (friends and relatives, instead of the best qualified).

The Prosecutor recommend 135 to 169 months and the judge had the option on 135 or 169 plus 60 months on the 19th count which totaled 229 months If this was the worst the judge ever saw why not give him the most he could 229 months not 135 months I hope his pension does not start until after the 135 months even if he gets our early

I'm tired of the jobs that get handed out amongst districts all over. That is criminal and should be investigated. It isn't just TR. Look at any surrounding district's websites and take note of familiar names. In today's poor economic climate there are hundreds of people applying for these school jobs. However, daughters, nieces, sons, my best friend's son....list goes on and on, get hired.
Ritacco's crimes were horrible but school corruption all over needs to addressed. It makes the good, hard working school employees look bad.

What needs to done is to re-write the law governing pensions and medical benefits to those state employees who are convicted of a crime, of any sort, in which violates or betrays the public trust. Complete and utter forfeiture of pension/benefits. I, by no means profess knowing the laws that encompass state benefits and pensions but Joe Scarpelli, former mayor of Brick was convicted on charges of bribery, sentenced only a short time in prison, and comes out with lifetime pension and medical benefits. Change the rules and you'll see more officials on the straight amd narrow.

I had a former teacher tell me that once Ritacco is/was actually convicted of a felony crime (has happened) he can ONLY collect any actual monies deducted from his paychecks, but NOT any other monies added to or included in any way in his pension package / retirement. So let's just assume for the sake of Sh*ts and giggles that Ritacco had $200 taken out of each paycheck (2 cks a month) over the years... THAT would be the only money he can get back from his pension fund/retirement packages. Now, knowing Ritacco as we all do (crook) I'll bet he didn't have ANY pension taken out of each paycheck, nor anything else. Too bad, for the cheater, huh?

There is plenty of blame to go around, the voters for not coming out to get rid of the BOE, Lake Ridge residents, who got a bus for their votes, Green Briar woodlands, who wouldn't let a debate happen in their development because a board members parents lived there, the parents who claimed their kids got a great education at Toms River Schools, while ignoring the poor SAT scores and the District low state rankings, the friends of the administration that yelled and screamed at the BOE meetings when anyone got to the mic that didn't agree with Ritacco, the intimidation that was used on people within the district not to vote for anybody other than the administrations candidates. For myself I feel vindicated with this sentence, the two years running for the BOE, I took a monumental amount of abuse for running against this administration, I pointed out a lot of the abuses by the administration and the BOE, but never did I imagine this. Every BOE member should be prosecuted for betraying the public trust. Wake up people, living in Toms River is like living in a third world country. When people are afraid to speak up publicly, whether it's against people in the Municipality , or people in the School District can we really say we live in a free and democratic society. So for people like Carol Benson, Dennis Galante, Nels Luthman and Bob Halieg, all I can say is thank you for your time and effort in trying to keep in check, a town and School District that has lost it's way.

@ragtime, for the record, if going to the person that heads the District to have the District do what they should be doing is asking for a favor, then you're misguided. My daughter is disabled, the route she was on for school bus pick up for the boys would not allow my grandsons to be picked up there, the boys had to be driven from Seaton Rd every morning to out by Midas muffler on Rt 37E. Ritacco took care of it, he could have ignored it because of who I was, he didn't, but I would hardly call that a favor, it was more like the right thing to do. That whole bus thing was ridiculous.

Margaret is a true professional who goes out of her way to help anyone with these issues. Bressman, not everyone works for the school district. I don't. I do have friends that work there, NO family, just friends. Many of them are good, solid, taxpaying people. Yes, I know about your run for the Board and I agree that you took abuse during that time. I wouldn't say that I have an allegiance to Ritacco, however I certainly will NOT get on this bandwagon of bitterness and hate toward the man. He took responsibility for what he did and will now pay the price. End of story. If there are no EQUAL or BETTER sentences for D'ALONZO, GARTLAND & COTRONEO, then we can only conclude that this was a political fiasco of major proportions. I fully expect the TRPatch and the rest of the media to follow those 3 individuals as closely as they did the Ritacco part. And, Bob, we taxpaying citizens pay a very steep price for this free, democratic society we live in, whether we speak up or not.

@Old Timer Nels Luthman is a retired teacher, he earned his free benefits for life, these were negotiated benefits as was Bob Halieg's, If your company gave you lifetime benefits would you give them up even though you worked to earn that benefit? You should be glad that people like this are putting the BOE and the Town under the microscope as to what they are doing now. Are you aware the town pays over a half million in supervisor salaries just to run the park system, do you have any idea what their pensions and benefits amount to. The salaries that administrators get and pension and we the taxpayers give them each a $15,000 tax free annuity to retire with, are you kidding? Do you realize that the Newark School District pays out tax free annuities to hundreds of people in the district and it's on your dime because it's an abbott district school. Stop worrying about what they're getting and start worrying about what we will soon be paying out to the people who are in the system and haven't collected yet

Robert, I have to agree with "Oldtimer". You are wrong, yes I am retired and recieve a full benefits pacage. From the private sector not the taxpayers back like Haelig and Luthman. My benefits are paid for from my private 401-1, saving plan and my employers private business pension, not your dime or mine. Those two cost the taxpayers of Toms River over $75,000 a year in free health benefits on my dime, it was NOT private money it is public money.What don't you people get, the tax payers are over burdened by this.Don't compare these two that get free health benefits and a pension on the public dime opposed to private money.

Hopefully this scum never sees daylight again. Wahhh, I'm sooo sorry now that I have been caught. We can only hope his lawyer was right with his statement he had only 10 years of life left. Now on to the board. I spoke at the meeting when he resigned and the board chastised me suggesting that they were too blame as well and that they should resign. Hmmmm. All employees in the district should be reviewed to how about their appointments came about, especially a few we all know are his boys and they should either can them or treat them as day 1 employees, tenure and salary wise.

Spooner, Joseph is Robert's son. Schiff was and probably still is a part of that group along with Carol Benson, Dennis Galante, Kathy Lazarro, the Golembeski family and others. Robert Haelig's daughter is Mary Gethard. TR Patch became their new home after OCPolitics died off. As Democrats, they are no better than the Republicans in town. In fact, if you remove "politics" from the equation, you're pretty much left with "The Hatfields and the McCoys"! Let's all bring our lawn chairs and line Washington Street and watch them duke it out. Don't forget to bring a jug of "moonshine" - many in the group can't function without it! BOTTOM LINE here is if anyone thinks TR and TRRSchools is any different from any other town or school district in this state, then they're not dealing with a full deck. This town and it's politics, out front and behind the scenes, is about as real as reality gets.

Hey Linda, Betty, Marra, Do you all remember when you all voted to give Betty's daughter a job that she really wasn't qualified for? Oh, that's right we weren't supposed to know that. But, then again people that she works with really do have loose lips! What are you all upset because some of these people may have been correct in what they had been saying for years? Perhaps people like Carol Benson and Dennis Galante, Charlie Henry, Kathy Lazaro really knew what you as BOE members were turning a blind eye to? But, then again you could not shut them up because they were not looking for jobs for themselves or anyone in their families! Why do you feel that these people need to be attacked? All they wanted was the BOE and the Super to do their job, and that is give the teachers the best materials to educate the children of this district! As these children are our future! When Dennis Galante asked a question of a BOE member about a "private bus company" that was on a bill list he was told that this district did not utilize ANY "private bus company." This question was asked after the vote for paying the bills was already taken and passed. It later came out that Mrs. Vasil was wrong and that the district DID utilize Murphy's Bus Company! So, if they were wrong with something so simple as this what else were they missing? Oh, that's right the Judge answered that question for the taxpayers of the district!

There should be an audit of every employee hired during in the Toms River School District during the Ritacco era. Many teachers have made comments that the only way newer employees could get a job in the district was if they were a friend of Ritacco's. Look at the Seaside Park Councilman who was hired as a teacher by Ritacco as park of the deal to get the Seaside Park students into his school, and then didn't come back after Ritacco was arrested. Ritacco may be gone, but his stench is still in the halls of those schools.

A few more thoughts:

1. Was his wife at the sentencing hearing, or was she down in Naples checking on the safe deposit box?

2. Every single BOE member from the last 20 years, with the exception of the three that were just elected last year, need to be investigated and possibly indicted. There is no way that they can sit there with a straight face and say that Mike betrayed their trust when in fact they knew everything that was going on and turned a blind eye to it. They are all as dirty as Ritacco, plain and simple.

3. I'm sure Mike did some singing before sentencing; can't wait to see who's up next in the prisoner dock. In addition, his buddy Dale Orlovsky is going to jail for tax evasion for skimming cash receipts from his bar. He probably told the feds a few secrets on the way to the slammer -- especially when it came to that failed deal for the school district to purchase Camp Albocondo (which Orlovsky's corporation owned) for triple its value and turn it into an all-day kindergarten (next door to a Superfund site, I might add -- wonder who was going to get the contract to construct that building?)

You are an idiot. First of all I assumed you weren't a teacher because you are smart enough to be a teacher. Vilified and Demonized ??? Come on now. And no one said that they weren't entitled to good benefits. But who defines good benefits when the economy is tanking. I work for a very good company and if I got those benefits my company would go bankrupt. Christie saved their pensions and is trying to save their jobs (unless you listen to the teachers union).

Thank you Denis. I'm reading all these comments, and I have to wonder, why are some people trying to throw the mud at Christie? Everytime somebody suggests that they investigate the rest of the board, the subject is changed. We all know there others that haven't been caught yet. Do they really expect us to believe all these well educated people were fooled by this guy? I don't believe it. They all turned their heads and let it happen. I hope somebody keeps digging till they get ALL of them. To suggest that the voters are at fault is insulting. How could any of us have known the extent of the corruption? I know people who took your head off if you even tried to suggest he was anything other than "wonderful".

Denis and Andrea Sorenson: To a certain extent, Christie is a bit responsible for Ritacco running rampant throughout the school district. When Christie was US Attorney, he had the opportunity to go after Ritacco when everyone was up in arms about the attempted Camp Albocondo purchase. Instead, Christie turned a blind eye because it was all happening in strongly Republican Toms River.

Ritacco only backed away from the deal when Oceans of Love, the NJ Sierra Club and the Asbury Park Press all voiced their objections. If they hadn't, there's no doubt in my mind that an all-day kindergarten would be up and running not 1,000 feet away from a notorious Superfund site. And Ritacco's pockets would have been lined even further, as they probably were in the case of the Bubble (where the public was told that it was to be constructed using funds from the Schools Construction Corp., until the head wrote a letter to the District telling them there was no money left for an indoor track and the taxpayers had to foot the bill) and the Poland Spring (now Pine Belt) Arena (the place that was supposed to bring in millions in entertainment revenue from big-name acts until contract restrictions prohibited these acts from performing)

There are just too many comments to cut and paste from the article re: Ritacco's new found sorrow for what he did. Like so many criminals before it's amazing how fast they see the light in the error of their ways. Had he not been caught,he'd still be living among the free and doing what he did best. It's a shame too because if he was smart enough to pull this off all these years,just think what he could have accomplished for the TR district and the students,but I guess in the long run he lived how he wanted and the decisions he made finally caught up to him. Now he says he's sorry...only because he got caught and will serve at least 8 years in jail. If he had never been caught there would never have been any remorse,except possibly him thinking "how could I have gotten more".

I read a bunch of comments regarding the pension and convictions. For many years with every story the person rarely loses it. One reason is if they apply for it BEFORE their trial and conviction they get it. So he gets arrested, is innocent until proven guilty so he immediately applies,. He gets his pension, then goes to trial and is convicted, sometimes a year or two after collecting starts and he still collects and gets his benefits free because he is there over 25 years as of last year. You can look on DataUniverse and see if he's on the public pension now. I didn't look but all public salaries are there and his arrest was in 2010

What the article fails to state is all of the people who were shut out of jobs while this creep employed friends, family and concubines. The fact that he takes responsibility only for one wrongdoing is what is reprehensible. He absolutely should be part of pension reform.
