It's been a month since William D. Kolb's Harley-Davidson slammed into Freeholder John P. Kelly's SUV,  but the toxicological tests done on Kelly at the time of the accident are still not back yet, state police said.

The investigation into the fatal May 18 accident that killed the 24-year-old Barnegat motorcyclist and involved Kelly has not yet been completed, State Trooper Brian Polite said.

It can take six to 8 weeks for toxicological tests to be completed, Polite said.

Kelly consented to the procedure, which is standard protocol in fatal accidents, state police have said.

Kolb was thrown from his motorcycle after it collided with the SUV driven by Kelly, state police have said.

Trooper Joseph Mezzo has said that Kolb was southbound on Route 9 on his black 2011 Harley Davidson at approximately 6:35 p.m. May 18, near mile marker 65.5. Kolb attempted to pass the vehicle in front of him, then collided with the right fender of Kelly's 2005 SUV when he tried to return to the lane of traffic, he said.

Kelly, 61, West Creek, was northbound on Route 9 and was attempting to make a left turn into the West Creek Deli when the collision occurred, Mezzo said.

The Ocean County Prosecutor's Office is not involved in the investigation, Executive Assistant Prosecutor Michael Paulhus has said.
