New Council to Mayor: Don't Sign Traders Cove Contracts

Council stops short of rescinding contract award at reorganizational meeting

 

An annual meeting of township government that is normally ceremonial in nature turned controversial Sunday, as township council members formally called upon Mayor Stephen C. Acropolis to put off signing two contracts that would move forward the Traders Cove Marina redevelopment project.

Minutes after four new council members, all Democrats, were sworn into office, Council President John Ducey asked for a motion to request that Acropolis, a Republican, refrain from signing the Traders Cove contracts, which were authorized Dec. 30 by the former council.

Councilwoman Susan Lydecker made the motion, and it passed unanimously, including votes in the affirmative from Councilmen Domenick Brando and Dan Toth, both Republicans.

The contracts, worth $3.6 million, include the final steps in turning the former marina into a public park as well as the construction of a spray park that township officials hope will generate revenue. Ducey said he was upset that the contracts were approved on the final day of the former council's tenure at a meeting that took place at 10 a.m., when some residents may not have been able to attend and express their views on the plan.

Business Administrator Scott Pezarras said the mayor – who was not present at the meeting – had not yet sign the contracts, and township Purchasing Agent Richard MacDonald confirmed the contracts had not been formally drawn up.

"If the contracts are not signed, they are not binding contracts," said Ducey.

The next meeting of the township council will be held Tuesday night, but conceivably, the contracts could be drawn up and signed before that time. That possibility prompted some in the audience to call on the council to formally rescind the vote of the previous council, but township attorney Jean Cipriani said that decision would come with some risks.

"If you rescind, there may be a basis for challenge, because it was a sealed bid process," Ciprinai said, cautioning council members that under state law, certain bidders' rights vest after a public vote.

"Rather than going the whole route of rescinding and opening up the township to lawsuits, it would be better if the mayor just didn't sign them," said Ducey.

Last week, township officials said funding for the two contracts had been set aside in 2010 under that year's capital budget. Pezarras has said that construction at the site must be started soon or it will remain a "dirt pile" for another year, as environmental regulations surrounding winter flounder migrations force a tight construction schedule. The park, assuming the latest contracts were executed, was set to be open in mid-summer 2012.

Cipriani said she would provide a memorandum to council members on their options on Monday. Ducey said the council would take up the issue again at the Tuesday meeting.

I can see him as the next Mayor and do a good job for the town if he doesn't get caught up in the greed and arrogance like Scarpelli and Acropolis. I wish him luck. Notice how Sangioviani and Toth changed their tunes in a desparate attempt to keep their seats. Will not work.

My concern is that we started something and will not finish it. Should it have been started in the first place? Probably not. But, not finishing the job does not help Brick. Maybe I don't fully understand it - are they going to finish the project, but just put the remaining work out for more bids? I hope we don't have yet another property sitting and rotting when this is all over. We already spent a lot of money to get to this point. My understanding is this work would be for the last phase. I am not political in any way - I just want what is best for all of us.

I say let the bidders sue... they won't win, they will just be wasting money on legal fees. The township can cry “Tort, Tort, Tort!!! The township needs to back out of this project now. While a park is nice, it seems like it will be a money pit in the years to come. What will it cost to maintain, police, etc.? - Now is not the time. Just pave the area over with environmentally friendly crushed shells so the property can be used and wait for better times or search for more options.

CBC; if the bidders will be wasting money on legal fees, won't the Twp also be wasting money on legal fees? While it may not equal the total monetary amount of the contract(s) it ceratinly will eat up funds as well as prolong the completion date.

They cannot just decide to lay crushed shells, it is a matter of what is approved by the (assuming) EPA or whatever authority as per the plans which have been submitted and approved.

While I'm not thrilled with the whole prospect of this out of hand,money pit of a project, it's time to finish it,get past it,learn from it and move on.

Happy New Year clam. I think CBC was thinking along the lines of the losing side has to pay the winners legal fees. That aside, this park does not have to be what Acropolis and clowns envision. We don't need a splash park, we don't need a banquet hall, and all the other frills they want. Town hall can handle slip rentals, put up a gazebo and bathrooms, like they have at Windward, and let it be.

The tax payers can not afford to pay for some luxury project this admin wants. As I stated in another post, in todays economic atmosphere, why are you maxing out the credit card, just cause the bank says you can. It is time to cut expenses and pay down debt, not accrue more debt and bankrupt yourself.

clamdigger, sometimes it is best to cut your losses. During tough economic times it may not be smart for a contractor to get involved in a legal action. -- Since they have no money invested only time for a bid which they knew they may not win.

We all want to see a quick resolution not only of this site but the Foodtown site. If the bulkheading is complete at traders cove, a simple drivable surface and parking area which allows proper absorption and drainage made out of crushed shells would be cost effective and much better versus black top. This would grant people access to the water for fishing, etc. If there is an existing CAFRA permit for the project, there should be no problem to use this solution to complete a phase of this project. -- I see people using the property by Spring.

I applaud the new council for wanting to see all the details before going forth with this park. Leave it just a park (like Point Pleasant's) for everyone to enjoy the bayfront all year round. It is a huge expensive undertaking not only now but for years to come. I only hope the new council reads all our comments on Patch to hear our concerns if we can't get to a meeting. Finally, we may have a council for the people of Brick!

I attended the Brick senior brunch at Leisure Park in Decemger. Unfortunately, the mayor stopped at our table. In the course of his comments, he said "he had money" and "can pay my taxes" He dissed all 4 Republicans that lost the election, saying he "never liked them" and only talked to them because he "had to work with them". In addition, he mocked the people who attend the council meetings, saying "look at the way they come to the meetings, dressed in shorts and t-shirts". So the next meeting you attend, make sure you're dressed in formal gowns ang tuxedos. Maybe the mayor would do the same then.

Yes to answer your question to me, I do have a thought about Traders Cove. I strart off with a question: Where on the banks of Barnaget Bay is there eleven (11) acres for sale at a basement bargain price, that of which Brick paid for this pristine location? It was a steal. Have you ever noticed this area before it was developed? It was an eye sore, now look at it now and what it will be when completed. It will rival all other locations in the shore area. It wiill pay for itself and give people a taste of quality of life never before offered at this cost. This is a bargain because it will serve people who need time to regather themselves due to the many discomforts that are being brought forth upon us by a president who wants to change our way of living and keeping us poor. I realize that during these trying times we all have to tighten our belts but making a political football out of something that benefits all is stupid . Both Republican and DEmocratic parties should smarten up and come together for the benefit of Brick. I'm an Independent but registered as a (R) and my thoughts are with our Mayor because I know he is an honest person and until the time he proves to me that he is dirty, Ill stick with him no matter how long it takes.Give him time and thought to prove himself and he will reward Brick with flying colors. You gotta believe.

Mr. Sholty, Thank you for your response. Traders Cove Marina was an eyesore and needed to be cleaned up and redeveloped. I just feet that the current plans are too much. As a life long resident of Brick, I m saddened by all the development is the waterfront areas. Who would have ever imagined that people would build expensive homes in the swamps? I would prefer that the location be kept simple and for the people of Brick to enjoy.

It's so nice of us Brick residents to build this park that will be OVERRUN by the residents of Lakewood.
Wait till you pull up with your family to enjoy a nice day at the park and see people wearing pants and suits walking around the water park and littering all over the place.

Think I'm kidding? Go to Manasquan Reservoir or Lake Shenendoah park. Those people have trashed the parks. A hundred unsupervised kids running around and trash all over the place.

All of the over development naysayers got up in arms, and now we have this. Local politics in action. They could make this a Sunday night movie will all of the drama. And for the record, when the lawsuits start coming in, then all of the tax payers foot the bill. So it's a drain on the coffers because of ineptitude.

I can't believe people would want condos at Trader Cove and not a park. Don't we have enough condos in this town? Each year that goes by, we residents loose areas that used to be open to the public, to the rich and elite building homes and condos on water front property. It's time to preserve some waterfront property for the rest of the non rich residents of town to use, to preserve open land for the future generations of this town. Plus a lot of you like to play politics with this whole thing, you bitch about a park because it was one political party's idea, but if it were condos going up you would still bitch and say a park should be built and to preserve land because it was another party idea. ridiculous! The park should be completed BUT without all the of the grandiose plans Yes include the spray water park as long as it is designed to look like part of the shore and not some industrial complex, a lot of you don't seem to understand what this spray water park will be like. So I Googled some spray parks around the country and here is one that is one of the best in the country, I don't think Brick's will be as fantastic as this one, with some of the comments I've read on here, most of you would just install shower heads for the kids to run through. Happy New Year Joseph. I whole heartly agree with you in reguards to condos. We have plenty of housing in this town already. One thing I just wanted to point out was, when the spray park idea was first brought forward, it was stressed it was going to be a "toddler" spray park. In other words kids under 6.

I agree no banquet hall, no frills of any kind. OPEN SPACE, as it was intended to be.

I didn't know it was going to be a toddler spray park, no it should be a full size spray park for kids of all ages to use. Would be nice to have a place you could take the kids and not have to worry about them being bit by jelly fish or swimming in polluted water like Windward Beach. The splash park, marina and hall space are revenue generating ideas that will benefit Brick. This project will beautify a township waterfront area and provide us another township attraction that will benefit all of our residents. Build the hall space and let all of our childrens sports teams & clubs use this facilty for their award banquets instead of going down to Toms River. Build the Spray Park which is a great attraction for our families with little ones. We renovated other parks in town (like Midstreams) which will not generate revenue like a spray park. The spray park is a small cost for a unique feature not found in many other towns.

There are many facilities already in town for rent. The VFW, American Legion, Firehouses and First Aid Buildings. These are all non-profit organizations that have hall rentals to help raise funds. There is no need to go to Toms River.

It is my understanding that the bulkhead material being used is aluminum being held onto the pilings with stainless steel hardware. Salt water & aluminum together?....HELLO! It doesn't work! The aluminum will be garbage in a few years, never mind any galvanic action taking place! Did any engineer look at the spec's prior to the install?

Bob -- Are you sure about this? To me, it looked like the same material used in all modern bulkheading, with the vinyl. Between DEP and Army Corps permits, you're pretty much regulated out of using anything but approved materials in bulkheading jobs.

Personally, I wish we could go back to pressure treated lumber. For all of its pitfalls, there's a strong case to be made that using the vinyl has helped the sea nettles proliferate because they can attach to it and overwinter, whereas they were not able to do so with the treated lumber.

Someone should take a ride over there and have a look. I remember them saying they were replacing all the bulkheading with vinyl, which did cause a stir because of the fact the nettles nest in them and lay their eggs there over the winter.

Me -- I took a ride over there a couple days ago, actually just after the council vote. I hadn't been there in a while. I'm 99% sure it's the vinyl used in all bulkheading today. Like I mentioned, that is HEAVILY regulated and there really is no way around using it. In theory, it's supposed to be more environmentally friendly than the old pressure treated lumber, but who knows. I've heard arguments going either way on it.

On another note, I wouldn't ride in there without 4WD ;)

Bulkhead material appears to be 6063 t-5 aluminum as listed on the original bid form.
The attaching fasteners are 304 stainless steel. I was surprised to see these materials being used given their acceptability to galvanic corrosion which would be even more accelerated by the saltwater environment. Why wasn't vinyl or composite sheeting used like most other bulkhead projects on the bay?

There is no doubt a perfect storm of galvanic and electrolytic corrosion will be present with an aluminum sheeting in salt water. Backfill of organic materials,some AC stray currents,undoubdtly aggressive and destructive DC currents from boats. WOW. Life expectancy is not long. This site can will a study class on what metals not to use in saltwater, with AC and DC currents available to accelerate corrosion. In corrosion lingo we speak of metals wasting,we can say the same of money invested,just wasting away!!!

Did you ever think of the $$$$ that will be generated by docking of boats? This is not a free-be. Also there is an OYSTER FARM located there that will help the bay residents, possibly yourself. A fee for parkinf too. All this via grants coming to Brick.

The shellfish portion will be run by ReClam the Bay, an organization which I've been involved with personally. They're really doing some great things along the bay in terms of both education and restoring the shellfish population, and they hope to return to Brick soon. Things got a little dicey in Brick in the shellfish upwellers with the wakes and such, but they're hoping to have a sizable presence at Traders once it's done, I believe. So that's certainly something to look forward to, no matter how the project progresses (and on what scale).

I have been reading the comments posted here for many weeks and I think that a few key questions have not been asked. Has anyone been to a spray park? What towns have the mayor and council visited to use as a model for this one? Colts Neck offers a free park that is appropriate for toddlers up to tweens, but you cant ever go to it because it is PACKED with people from everywhere in Ocean and Monmouth counties on a regular basis. Monroe township just built one recently and I am not sure if it is free to township residents or not, but will there be a break for township residents? We will see a huge amount of traffic at the base of the Mantoloking bridge which is already congested on a summer day. These parks can also cost a huge amount in liability insurance, water+metal+kids=injuries. I would love a place to take the kids for some fishing and crabbing and a sandwich. I would pay whatever the daily cost would be. I just dont think the town realizes how many more people will be coming to an already congested area.

They will subcontract it out to a company they deal with and pocket the difference. As long as the work is done there is no problem but they are on the hook for any problems.

Concerned - excellent points. FYI, the Spraypark in Colts Neck is a Monmouth County Park and has, to date, been free for everyone. The cost to operate it, is shared by all the residents of Monmouth County. In contrast, the costs to operate the proposed Traders Cove Spraypark will be a burden for only Brick taxpayers, not all residents of Ocean County.

Well, yes and no. The difference with the Brick park is that it would NOT be free. So in that sense, it would be paid for by user fees and, hopefully, generate revenue. That's the plan, at least. I've heard numbers that both support and dispute the idea of profitability, depending on who you ask and, often, which side of the fence they are on politically.

Don't get me wrong. A spray park in this town would be a great addition and let's face it, not many of us can afford a day at the boardwalk let alone great adventure or a water park. This would be a great alternative, but can you imagine what it would be like to try and make a left hand turn after the bridge has just gone up? I still don't think the outgoing council considered how many people could be there on any given day.

Concerned I agree. Traffic will be an issue. Mantoloking Road really needs to be 4 lanes. Years ago there was a plan to declare eminent domain to widen the road. Business owners and others were once notified. Widening this roadway would again be the best thing regarding any area improvement. When Parkway 89 opened there was a noticeable increase in traffic due to the direct shore route. Once it opens in both directions in 2014… It will be worse. The other big problem is the backup on RT 35 which holds up the works. That problem will never go away as more people head to the shore.

It is amazing how this article devolved to mudslinging. My major problem is the dirty po(litics)ol is shoving through the spending bills without legitimate reason instead of waiting until today or next week. That was EGO and Arrogance.
This is the first reorganization meeting I have missed since coming to Brick. The actions taken on Dec 30, 2011 were as bad as the October mudslinging mailer.
I do not at this time have an opinion on what is best at Trader's Cove because I have not heard the arguments. For some arguments in this context mean discussions or debates if you will. I have spoken to all the new Council members and take them at their word they will work in the best interests of Brick. To do so they need to evaluate the evidence they are given and that they hear.
If we do not stop thinking in terms of us against them (whoever us is and whoever them is) we will fail to have a town worth living in.
No one has all the right answers. No one is infallible and that includes the Pope of the Catholic Church who is only infallible when he speaks 'ex cathedra'. Check how often that has happened.

Bulkhead material appears to be 6063 t-5 aluminum as listed on the original bid form.
The attaching fasteners are 304 stainless steel. I was surprised to see these materials being used given their acceptability to galvanic corrosion which would be even more accelerated by the saltwater environment. Why wasn't vinyl or composite sheeting used like most other bulkhead projects on the bay?
I aggree with Bob and would like to know which Engineer at Birdsall Engineering did the specs and was corrosion given any consideration.

Speaking from experience… Birdsall Engineers are PERFECT and infallible! They can do no wrong! If the bulkhead quickly erodes and fails they will never be the ones at fault and will continue to practice. They would rather point the fingers and insult laypeople instead of taking blame for a mistake.

Heres a thought! Did all the scrape materials, cut offs and aluminum pieces filter back into the project funds or did they just disappear? Aluminum at recycle yards is big $!!
Remember the junk scandal at the public works yard a few years ago.....

Traffic light at the very least. I really hope that the new council gets a good look at all of the proposals and contracts before anything is decided upon.

Progress in Brick Must Not Stop. Projects take time to get through the necessary state agency approvals. Keep this project moving forward do not let it get tied up in politics......

That is a rationalization. How's the FoodTown(sale?)(development?) moving forward? Maybe we'll find out the TRUTH now. As far as anything else in concerned the Town Council calls the shots not the Mayor.
