Former Toms River Mayor Arrested On Tax Evasion Charges

JERSEY SHORE, NJ -- A former Toms River mayor was arrested late Monday on tax evasion charges, according to the U.S. Attorney's Office.

Carmine Inteso, 46, appeared in federal court in Newark Tuesday afer being arrested at John F. Kennedy International Airport in New York City last night.

Inteso is charged with three counts of federal personal income tax evasion and three counts of failing to file federal personal income tax returns.

He appeared before U.S. Magistrate Judge Mark Falk this afternoon and was released on $200,000 bond. An arraignment has yet to be scheduled.

He was arrested after returning from Afghanistan, where he had been working as a contractor, according to the U.S. Attorney's Office, which alleges he took a job in Afghanistan after learning he was the target of the tax investigation.

Inteso served briefly as mayor in 2002 and then served as deputy mayor for the Dover Township Committee in 2003. He served as a councilman-at-large from 2004 to 2007.

A Republican, he ran for mayor in 2007 as an independent but lost to Tom Kelaher.

According to the federal court docket, a warrant had been issued for Inteso's arrest on Nov. 10, 2011 — the same day an indictment was handed up charging Inteso with tax evasion, a federal felony.

Federal investigators allege Inteso used a sham company as part of a tax evasion scheme.

"Defendent Inteso also controlled a company that had ceased operating by at least in or about 2007 and was instead used by defendent Inteso to facilitate his evasion of federal income taxes," according to the indictment.

An insurance broker from Towson, Maryland would make payments to the sham company, and those payments totalled $133,235 in 2006, $127,304 in 2007, and $31,253 in 2008, according to the indictment. The payments would be more than $10,000 in a month. Inteso would then use these funds for personal expenses. The IRS says Inteso owes taxes on this income for tax years 2006-2008.

The indictment states the unreported income and tax delinquency is allegedly:

  • 2006: $155,226 unreported income, $26,971 in taxes owed.
  • 2007: $135,271 in unreported income, $20,839 in taxes owed.
  • 2008: $62,504 in unreported income, $3,206 in taxes owed.

The indictment alleges the insurance broker received premiums, brokerage commissions and fees on a yearly basis for providing insurance brokerage for the Brick board of education and for Toms River.

Inteso accepted payments from the insurance broker, through the sham company, the indictment states:

"It was part of the tax evasion scheme that defendant Inteso received compensation from the insurance broker through payments made by the insurance broker's companies to the sham company as directed by defendant Inteso, in order to concel such income and purposely evade the assessment by the Internal Revenue Service of federal income tax owing on such compensation."

Paul Brush, mayor through 2007, said Inteso was a nemesis of his.

"I was mayor for four years with Carmine Inteso. He was one of my chief antagonists," Brush said. As a Democrat mayor and a Republican council, "It wasn’t easy serving with a council that blamed me for everything. Carmine was one of my nemeses."

"All that said I’m not happy to see it. It's another blow to public officials," Brush said. "I'm very very disappointed."

Nels Luthman, president of the Toms River Democratic Club and a former member of the Planning Board, said Inteso opposed changing the government from a committee to a council in 2003.

"He didn't think there would be any interest. That encouraged us even more to get a petition going," Luthman said.

Kelaher, the current mayor, said he didn't know Inteso that well when Inteso served as mayor because Kelaher was the Ocean County prosecutor.

"I hardly knew the guy. I had no contact with him and I don't know anything about the charges. I didn't know him that well, even when we were running for mayor," he said.

Judge Joel Pisano is assigned to hear the case.

On June 25, Pisano ordered the case unsealed. With six months passing since Inteso's arrest, an arraignment originally scheduled for Dec. 2011 had been postponed. Inteso was arrested upon his return to the United States from working in Afghanistan, according to the U.S. Attorney's office.

Inteso could face five years in prison and a $250,000 fine for each of the three tax evasion counts. Each of the three failure to file counts carries a maximum potential penalty of one year in prison and a $100,000 fine.

U.S. Attorney Paul Fishman credited a number of agencies in the investigation: "special agents of IRS – Criminal Investigation, under the direction of John R. Tafur, Acting Special Agent in Charge, Newark Field Office – and the FBI, under the direction of Special Agent in Charge Michael B. Ward, with the investigation leading to the indictment. The Office of International Affairs in the Justice Department’s Criminal Division and the Diplomatic Security Service’s Regional Security Office in Kabul, Afghanistan provided invaluable assistance."

This is just another example of how deep and pervasive the level of corruption has spread in Toms River. It seems in the past year, every month a different employee of Toms River is being indicted, convicted, or is allegedly involved in some form of corruption. The Republican’s cronyism in Toms River needs to be stopped. This is why we need a complete reform of the Toms River political system and it needs to start with electing Bob Armstrong as the new Sheriff. Bob Armstrong, if elected, will start to clean up the mess and corruption the Republicans have left us with and allow Toms River to start over and start to move past all of these problems. The problem with the politicians in Ocean County is that whenever someone has to much power for too long, you lose focus on why you were elected (to help the people) and only focus on empowering yourself.

I never favored term limits in politics because I had faith that the American voter would have the sense not to allow candidates to make careers out of public service. Locally, these men just seem to get shuffled around from one position to another....be it MUA, or BOE, or Town Committee....taking with them the long-term benefits of each position. I admittedly stand corrected....the American voter isn't all that intelligent. You need look no further than Charles Rangel & the lifers sitting in office here in town. In my experience, a big part of the problem is voter apathy. People who moved here from Northern NJ & NY, many of whom commute to jobs there, are not inclined to take an interest in local politics, thus maintaining the "status quo".

Are you for real? McGluckin owed back taxes on earning/income he REPORTED on his taxes. There are three of the "Ritacco Six" that are up for reelection and they are Gus Kakavas and John (Jack) Reuther from Toms River and Jamie Ann Jubert from South Toms River. Then we can rid this board of the other three of the "Ritacco Six" in 2013. Then the next thing that needs to change is to rid this school district of Roselli who was and Asst. Super under Michael J. Ritacco for 9 years, Debra McKenna who has been an Asst. Super when you guessed it Michael J. Ritacco was the Super, Joseph Pizza who is a retired Principal and we the taxpayers are paying him something like $500.00 a day to be an Asst. Super and last but not least James Hauenstein who was made Asst. Super after being a Ritacco yes man.Then hopefully this district will be rid of the "black cloud" that has been been a MAJOR distraction to the education of the children of this district. Perhaps if the BOE had paid better attention to the contracts they would have seen all of this money that should have gone to the classroom so the teachers would have the BEST tools to educate our children and perhaps if they had checked to see if all of the "i's" were dotted and the "t's" were crossed we the taxpayers would not have seen the LARGE tax increases that we have seen.

The story here is Ritacco. He has enough knowledge to bring down the entire Ocean County political system overnight, along with a very healthy chunk of NJ state government. Ritacco could be the straw that broke the camel's back. His insight into the true daily operations of politics could even so infuriate the public that they would actually stand up and reclaim their government, thus realizing property tax savings of 40 to 70% in 3 or 4 years. If America was to be so blessed by Ritacco, I, for one, would be willing to forgive everything he has ever done wrong, no more questions asked. Deals like that don't present themselves every day.

I agree. IF Ritacco, gives up everything he knows. Understands he wrong and we wont tolerate it, it would be more helpful than him sitting in jail. They say power corrupts, its true. Why do ordinary people who start to improve things, switch to, they are more important than the people they represent? I am a democrat, but I vote person NOT party. Would be wonderful to live in a town, where it was all for one and one for all. Instead of jailing Ritacco, make him do public service for free. Why waste his talents and education. Make him pay back his town with HIS TIME and talents!

TRWatch - When I campaigned for mayor, I publicly stated that the mayor of TR, 7th largest town in NJ, should be paid $75,000. Council approved approx. $27,000 for first 2 1/2 years and raised it to $75,000 in my final 18 months. My final budget had no tax increase but then I amended it because the state suddenly imposed a 4% hard cap on taxes-no exceptions. This meant that Mayor-elect Kelaher would be short $5million in his first budget and he would have to lay off at least 20 cops and 30 or so non-cops. I had added 10 cops to an understaffed police force during my term so I could have left Mayor Kelaher, and the town, in a lurch and gone out with no tax increase. That was easy. Instead, I told him if he would back me, I would amend the budget and take more out of surplus and make up the difference in taxes to preserve the police force. He agreed and publicly thanked me, verbally and in a letter to the taxpayers in Jan. 2008.(I'll send you or anyone a copy of his letter.) Had I not done what I still consider the right thing to preserve the police force, the tax increase over my 4 years would have been much less than we had all anticipated when we took office. As you know, in last year's campaign, the mayor blamed me for raising taxes. I guess he forgot how I helped him. Please remember, it is the council who actually votes and approves the budget. They have complete, final authority to increase or reduce it, and, of course, they approved all four of my budgets.

Kelaher was the one who was recommending it.. and based upon what was coming out of Trenton... wanted to build a suplus and even out tax increases over 2 year period.
TR was on a fiscal calender back then (June to June).

In other projects, such as the JSM at Hickory project in Dover Township, Mr. Lynch does not have an ownership stake, but he and Mr. Morris together gave $65,000 in donations to mayoral candidate Paul Brush in early 2003. Once he was elected, Mr. Brush embraced the plan and appointed one of Mr. Lynch's allies to the local planning board. The project's newfound support on the local level helped JSM at Hickory win two state zoning changes, even though hundreds of community residents had rallied against the development.

Mr. Lynch said that the donations were intended solely to strengthen the Democratic Party, and had nothing to do with the development.

"I don't even know where that project is," Mr. Lynch said during a recent interview.

Mayor Brush said that his support for the proposal was based on its own merits. State officials said JSM at Hickory has been moving ahead because it will help the town meet its obligation to build affordable housing.

But some local residents say they feel as if local officials sacrificed their quality of life for campaign contributions.

"It was stopped until they came through with all the money," said Frank Kenny, who organized community opposition to the plan. "Then it was like we didn't even exist."

"When it comes to the pay-to-pave system of development in New Jersey, John Lynch is king," said Jeff Tittel, director of the New Jersey Sierra Club, which has opposed Mr. Lynch and his clients on dozens of development projects around New Jersey. "In parts of the state, you can't build unless you hire one of the lawyers or engineers or construction companies he's aligned with because you won't get the government approvals."

A Languishing Project No More

One example of Mr. Lynch's converging interests is a strip mall in Brick, called The Power Center. It was originally proposed by Mr. Morris, a developer who frequently hosts Mr. Lynch on his yacht and jet and has given hundreds of thousands of dollars to his political committees. In 2003, Mr. Lynch was brought in as partner in the languishing project and soon his political action committee began donating tens of thousands of dollars to the mayor of Brick and other local Democrats.

The project, JSM at Brick, quickly won approval from local officials, and the town's mayor, Joseph Scarpelli, was hired as a consultant by an engineering firm working on the project.

Mr. Lynch said that their donations were a mere coincidence, unrelated to the development. Mr. Morris has declined to be interviewed over the last month. Mr. Scarpelli has explained that he did not know Mr. Lynch had a stake in the project and later quit the consulting position, saying he wanted to avoid a conflict of interest.

At one debate the most arrogant of comments rolled off his tongue in that if he as a Business Manager wanted an accountant I’d hire one. Why burden the taxpayer with Ritacco's incarceration when he already stole from the taxpayers and through his prison time will cost the taxpayers even more. There is no debating Ritacco's contributions to the TR school system...creating revenue and offsetting taxes... and if he was to serve community service time he could act again as superintendent and business administrator!. Oh the savings! Rosselli and Doering and that's 600k plus a year! So he could pay his 2 mil debt off, owed to the taxpayers of TR in 3 years and then throw him in jail to serve the FBI and IRS and legal associated costs and jail time! So let him serve confinement and still consult TR schools and then we can actually make money off this guy! Leave him out of jail and let him sing,sing sing! How much will we the taxpayers save when more crooks go to jail? So much for the Carmine Inteso story and probably repeating what was already said!

Its the man not the Party! both were good guys coming into the political picture and had good intentions. The power seems to just take over their greed and they fall to temptation. Punish them for what they do and understand that the people who vote can change the political atmosphere at any time but the chances of getting a crook are just as good with the party swing.

I would like the tax picture to stay level and the workforce to be protected and the people in charge have basicly done that. The problem is some have done well for themselves as well and that is wrong. Punish the guilty not the rest of their party it is not fair.

Rotting in jail is one option. Another option is to let him serve the community he stole from. You do not think that would be humiliating in itself? Let him teach reading to poor kids at the library, or tutor those kids falling behind or serve food to the homeless. Clean the sides of the roads. Lock him up at night and let him work, for us, during the day. I kinda like the idea : )

Someone please explain why the Insurance company and or Broker would make these "commision" payments to Intenso?
Did Intenso have the authority to make certain this Insurance co. would continue to do business for the township of Toms River?
Could Intenso have allowed "overbilling" by the Insurance co. to the township?
Were the payments to Intenso supposed to be funneled to someone else?. maybe with Intenso recieving a small kickback?
Why were the payments made?
There is more to this than just Tax Evasion. people just dont give money away.
