Brick Man Charged in Sex Assault on Girl, 11

Brick, county authorities arrested a Birch Street resident Feb. 17

 

A Brick man is behind bars after being arrested on multiple charges stemming from a sexual assault on an 11-year-old girl.

Floyd Sinclair Jr., 39, was arrested Feb. 17 after the parents of the girl brought her to Brick police headquarters to report the assault, which they said occurred at a sleepover at Sinclair’s Birch Drive residence the night before, according to Sgt. Keith Reinhard.

Sinclair is a relative of the victim, Reinhard said.

Detective Timothy McCarthy from the Brick Police Investigations Unit and Detective Lindsay Woodfield from the Ocean County Prosecutors Office investigated and, as a result, arrested Sinclair.

He has been charged with first degree aggravated sexual assault, second degree sexual assault and second degree endangering the welfare of a child.

Superior Court Judge Francis Hodgson set Sinclair's bail at $150,000 cash.

A check of jail records confirms Sinclair is still being lodged at the Ocean County Jail.

well, i'm here to play devil's advocate. since there are no specific details to what transpired at the sleep over and that the man is a "relative" of the child who knows how much more to the story there is here.

I know doing what's best in the interest of the child is important and that the police do a preliminary investigation. This one lasted about 1 day by reading this article.

Also, there is no mention if the child was or was not brought to the hospital for an exam and to what extent the assault was. While i'm not looking for graphic details, just something to understand why the guy is in jail.

I'm not a big fan of just "taking the word" of an 11yr old saying this or that happened, especially against a "family" member where there may or may not be some kind of back story. i'm not saying the guy is innocent or that I condone sexual assault on children, but it's been known to happen that a child exaggerates a little and is afraid to go back and reveal what really happened thus putting a mans reputation forever in the crapper. sometimes i think it's better these kinds of reports never go to press until a full investigation is done and a verdict from a trial is rendered.

dear clam digger not to play devils advocate but u should look up the definition of first degree aggravated sexual assault it involves penetration of a minor under the age of 13 that causes grave physical injury to the child this does not sound like a charge that can be placed on someone without physical evidence there is a reason y there is 150,000 cash bond on this guy and its because he shouldnt b on the streets

Are you cray, there should be no reason a child says something like that at 11 that could be explained. You better get you head examined also. Children don't say stuff like that at 11 if it isn't true. People like you are the reasons these dirty monsters get away with touching or worse to a child. It's time to listen to these children so many years these dirty perverts have gotten away with this inappropriate behavior. Wake up this world is full of molesters.

I agree! The prisoners will provide the justice! Clam digger, there are a lot of false reports but aggravated sexual assault usually is not a claim an 11 year old would make up....an 8 or 9 year old perhaps. God Bless that family and that poor girl. Crazy world we live in!

Why would parents let an 11 year old girl sleep over at any man's house even if he was a relative? You can't trust anyone. I am surprised they even mentioned that it was a girl. Usually that is kept quiet along with the name.

I didn't say the man was innocent and since sexual assault can be of various forms, I will not delve into a graphic scenario conversation of what could or could not have occurred at this sleep over, there was no mention of a trip to the hospital and if a trip to the hospital had occurred and there were signs of a sexual assault the police would have been called to the hospital, not the mother bringing the daughter to the police dept. the next day. I don't like people who prey on kids and if the guy is guilty then he deserves everything he gets while in jail. Now that being said, if it eventually turns out this guy is innocent, his name is forever linked to sexual assault on a child. That crime and accusation is far more unforgiving then even murder/manslaughter and a host of other crimes. Just because a crime is investigated and charges levied does not mean he is guilty which is why I wrote that I wish these crimes were not published until after trial and verdict.

Clam digger....I was molested by an uncle from 8-17. My parents failed to do anything about it. I'm glad these parents stepped up. My cousin was molested by this uncle as well she was 17 and threw herself in front of a train 4 years ago because no one believed her. It's a patents responsibility to protect a child at all costs. Police will not just arrest someone because a parent contacted them. They need evidence. This is a child we are talking about... Playing devils advocate is ridiculous. This child will be effected for the rest of her life because of this piece of garbage. Her life is forever altered. Have some respect.

Why are you all attacking what clamdigger is saying.He is only stating that sometimes people including 11 year old's lie! Not to say this girl is, just saying it DOES HAPPEN!!!
I know this first hand as someone close to me was accused and without a doubt innocent but he will never get rid of people still looking at him and wondering!!!!!!
The girl had major problems and made up a story so people would feel bad for her and so she could get away with everything she did.She was 13 and she never had to answer for ruining someone's life.Please just wait before you say hang him!!!!!!!!!

I'm pretty sure 1st degree aggravated sexual assault means evidence and the child was definitely examed before the charges were pressed. Maybe the parents first thought was to have him behind bars before he had a chance to do it again

I just looked it up for NJ and 1st degree sexual assault means penetration occurred either vaginally or anally, needless to say proof of penetration on an 11 year old would be pretty obvious especially vaginally because the hymen would no longer be intact. So everyone can stop guessing if there was proof and focus on an 11 year old was abused

As I said I am not going to get into a detailed conversation that I do not feel is appropriate regarding the situation this forum.

There are many forms of 1st Degree sexual assault, I suggest you read N.J.S.A. 2C:14-1 Definitions. Other than that, to keep a civil decorum here I will not get into a detailed discussion on this topic that will open up a can of worms leading to unnecessary graphic explanations. I've expressed my opinion and as far as I'm concerned that's enough.

Oh sorry now that I looked up the statute you gave it does include oral sex. I find it odd you say you don't want to get into a discussion and open up a can of worms yet you started this discussion. You don't feel a detailed conversation is appropriate yet your first reaction is to doubt the child. You seem to have a vast knowledge so are you a sex offender or just friends with this guy?

well, first of all I did not start this discussion, I was the 8th person to post a comment.

secondly, if one has children in their life they care about, they have a tendency to try an be up to date on certain topics, especially this day in age with sexual predators. So if you real enough news, watch enough educational TV you can get a pretty good idea of what the law is. If that's not enough, it's simple to "copy and paste" the phrase "first degree aggravated sexual assault" into any search engine and in a matter of seconds get some excellent sources of info and continue educating yourself.

finally it's been known to happen that false accusations have been made, arrests made and finally the real truth come out way down the road that the accused was in fact innocent of the charges.

as far as my comment regarding going to the police department and not the hospital, it's my understanding that if a child was assaulted the hospital is required to call the police and report the crime against a minor the same as reporting a gun shot wound. if it were a child or relative of mine regardless of what signs were or were not visible at home or what the child said happened, a trip to the hospital for a full examination by an experienced doctor/nurse would not be questioned as well as having the police/detectives there to gather any evidence.

I think all child molesters should get death penalty. It's not bad enough they get a smack n their hand and get out in no time at all, maybe get parole which is also a joke, no one patrols parole enough the poor child has to worry the may see them again or most likely he molests another child. When someone's mind is sick enough to want to molest a child, there is no rehabilitation that can help them. Something is off in there brain. They can't be helped and it is a real shame, the world is full of these sick people.
