Brick Council Meeting Explodes in Anger, Shouting; Restructuring Measure Passes
Acropolis pledges veto of ordinances; Council President asks special police officer to remove mayor from room during meeting
A township council meeting exploded into a shouting match between Council President John Ducey and Mayor Stephen C. Acropolis before the governing body passed, in a 4-3 vote, a controversial pair of ordinances that will both eliminate and create positions in township government.
In a meeting that spanned more than four hours – most of which was dedicated to a sometimes-raucus discussion of the restructuring plan – township officials battled over whether the restructuring would save money or cost money, promised lawsuits and accused each other of handing out political patronage jobs.
Acropolis promised a veto of the ordinances, which his administration says will cost taxpayers approximately $130,000 and lead to “political hacks” being appointed to at least some of the newly-created positions.
Council President John Ducey said the move will eliminate $418,000 in salaries by eliminating five salaries and eight positions – some of which are not filled – and allow township government to become smaller and more efficient.
But Township Attorney Jean Cipriani warned the council for a second time that enacting the ordinances – which they eventually did – could lead to lawsuits by employees as well as a finding that the township violated the Open Public Meetings Act via the state’s Rice Law, which allows employees notice before their jobs are to be discussed at official meetings.
Cipriani, at the direction of the mayor, read a lengthy statement citing the state’s Faulkner Act – the law that sets forth Brick’s governmental structure – as well as case law, and explained in advanced legal language how portions of the law may violate that act and could be thrown out in court.
Acropolis also said some of the people whose jobs are being eliminated could be bumped to Civil Service jobs with higher salaries than they are collecting now.
At one point during the meeting, Acropolis took aim at Republican Councilman Dan Toth’s motivations for siding with council Democrats in spearheading the restructuring law (see separate story), implying he favored the law because it would eliminate the position held by Deputy Business Administrator Juan Bellu. Acropolis implied Toth wanted to eliminate Bellu because he would not adhere to requests from Toth to help business clients receive favorable treatment in opening liquor stores.
Toth would later say he was merely helping business owners after they contacted him, as he has done with those he has no business relationships with.
Ducey – Acropolis Altercation
The discussion turned especially sour when, during a public comment period, Ducey accused Acropolis of refusing to allow council members to speak with Business Administrator Scott Pezarras and others in his administration.
“That’s a lie,” said Acropolis.
“I’m running the meeting and I didn’t recognize you,” replied Ducey.
When Acropolis began to explain his position, Ducey banged his gavel, repeatedly telling Acropolis that he runs the meetings and Acropolis should not speak. The pair’s voices grew louder and louder until they were shouting at one another, at which point Ducey asked a special police officer to remove Acropolis from the council chambers.
“If anyone puts their hands on me, if you put your hands on me,” Acropolis said, at which point Ducey cut him off, shouting, “He’s threatening an officer! You can’t threaten an officer!”
“Vinnie, if you put a hand on me, I'll sue everybody here,” said Acropolis, referring to the officer.
“If you're gonna lie, Mr. Ducey, that's it, we're done,” Acropolis then said, briefly sitting in the regular audience section of the meeting room before leaving, along with Cipriani and Pezarras, who he instructed to exit the council chamber.
At a later point in the meeting, Ducey read a number of e-mails from township officials saying they could not answer questions about the restructuring plan because the mayor had instructed them not to.
However Acropolis provided to Brick Patch an e-mail dated Sept. 19 instructing Pezarras to “Please answer the Councilwoman’s questions in a timely manner,” referring to questions submitted by Councilwoman Susan Lydecker about bill resolutions.
Acropolis also provided a copy of a similar e-mail from Sept. 13 instructing Pezarras to provide information to Councilman Jim Fozman.
“Some quieter times and some [cooler] prevailing heads should probably take place,” said resident George Scott, following the exchange.
“What's going on here tonight is a lot of politicking and a lot of grandstanding,” said resident Nan Coll.
Ramifications of Restructuring
Eight senior positions – some unfilled – which amount to five salaries in township government, including those held by Deputy Business Administrator Juan Bellu and Recreation Department Head Dave Francese, will be eliminated under the plan. The job of the council's secretary will also be eliminated and will be replaced by a deputy municipal clerk.
The departments of Recreation as well as Community Development and Land Use would be eliminated entirely, with their operations rolled into other departments.
Deputy department head positions for the Finance Department and the Tax Assessor would be created under the plan. A deputy township clerk position would also be created.
During the meeting, Acropolis took aim at Ducey over the elimination of Council Secretary Jennifer Hartmann’s job.
“You want to get rid of her not because of her [job performance], but just because you want to create another position for a political hack,” said Acropolis, who then alluded to rumors former Democratic Councilwoman Kathy Russel or Democrat George Cevasco – who recently dropped out of the Ocean County freeholder race – might get the job.
“This does two things: it goes after two members of the administration who were department heads, and creates a $90,000 position in the clerk's office that will be filled with a Democrat politico,” said Acropolis. “It's smoke and mirrors. You say you're eliminating positions that have nobody in the positions.”
The entire exercise may end up in court eventually, some surmised.
Cipriani said there is a chance employees could sue the township, or the administration could end up facing off in court against the council over whether the ordinances are in accordance with the Faulkner Act or not.
In that case, the administration would be represented by Cipriani – a member of a Republican-aligned law firm – and the council would presumably be represented by Democrat-aligned attorney Charles Starkey, who authored the restructuring ordinance.
Council members Toth, Ducey, Fozman and Lydecker voted in favor of the ordinances. Council members Bob Moore, Domenick Brando and Joseph Sangiovanni voted against them.
Those in favor of the restructuring defended the measure, saying it will lead to smaller government in Brick.
Fozman said “too many unnecessary management positions” were created by the administration and the measure marks a “crucial step towards savings hundreds of thousands of dollars.”
“We want to cut back,” explained Ducey. “We want to change the structure of government.”
“We couldn’t do it earlier” than now, Ducey said, because if the restructuring had been proposed earlier the mayor could have interfered in the passing of the township’s 2012 operating and capital budgets.
“Business and Finance had meetings, and we had to have our own attorney,” said Ducey. “We're trying to do what's right, we're trying to make the cuts that we think are needed.”

Scott is an employee. His position is under the purview of the Mayor.
As to the legal Council who is appointed (in this case not so much with advice and consent) to serve as legal counsel to the Township I believe the wording is not clear that she answers to the Mayor.

This is the ideal replacement for MTV's Jersey Shore.
Imagine Acropolis accusing someone of wanting to eliminate township positions to appoint "political hacks".
Toth now wants to eliminate these expensive/unnecesary positions, but does he get a free pass, for not speaking up when they were put there in the first place and his helping hand in the liquor store problem, could raise one's eyebrows on that connection. Wish he would have spoken up when township employee's cars were photograpghed because they had D's bumper stickers on their personal cars and told they couldn't use the township parking lot.
Ducey who disappointed us with his flip flop on taking insurance, did to the Mayor, what the Mayor had done on several occassions to Scarpelli, reminding him he's a "guest" a these meetings.
Imagine the position that poor cop was in. Think he was worried about being employed the next day ?
While the Mayor may want to leave the meeting, to insist the township BA & Attorney

For those who were not in the audience, when the Mayor was being approached by a good natured and frightened special police officer to be escorted out, Acropolis yelled, “Vinnie, if you put a hand on me, I'll sue everybody here,”. AT THAT POINT OUR POLICE CHIEF, WHO IS A RELITIVE OF THE MAYOR, went up the side of the chambers and whispered into the Mayor’s ear. I can imagine what was said and IMMEDIATELY the Mayor backed off a confrontation with the special police officer. Thank you Chief.

From the beginning I wondered why we needed another head of the Recreation Dept. who when hired was making $90,000.00. We had a director there and many workers who did the job to run the dept. This new hire was a friend of Mayor Acropolis. This position was not needed. Yet, he has been in this position for many years making over $100,000.00. My husband has been working in the same job for 29 years and is not making that much. Mayor, it's time to move on. The people spoke at the last election. You have not saved us any money over these years you have been in office. I did vote for you thinking you were going to do a good job, only to see how you lied right to people and became a bully.

I cannot believe the comments I am reading about this story. Either these are from all the same person posting over and over again as different people or we have a truly sad state of affairs in this town when people after being at this meeting, or reading this article, find it appropriate to bash the Mayor and namecall. This Council is acting outside the law repeatedly. They are repeatedly warned by the township attorney that these votes they take can result in lawsuits, but THEY DO NOT CARE! They just want to punish Acropolis any way they can. It's a microcosm of what Obama is doing via Executive Orders! Forget Congress, forget the Constitution. There are rules and LAWS for a reason. I cannot believe the behavior and disrespect shown last night for the LAW and the OFFICE of Mayor. Ducey should step down from office!!!!! He does NOT deserve to hold the honorable position of Council President. WHAT A DISGRACE!!! Acropolis never treated Scarpelli like that!!!!! Anyone applauding this behavior should be ashamed of themselves. It's not all about politics, people. It's not all about winning and losing. This is about our town! Apparently respect for police officers mean nothing to you, threats means nothing to you, and udder disrespect for this town means nothing to you!! Lets just let Acropolis do what ever he wants or he might have a temper tantrum! well someone needs to step up and do something. By what you are saying, it is alright that Acropolis hires his friends in over paid positions, puts out more money in salaries for parks and rec than he actually puts into fixes the parks. This is all alright. He can have he people vote for things, then wait a year and star the process of going against what the people voted on. He wants to be praised for "not taking benefits" oh yea cause you get them from your wife, also tax paid benefits. He has been sitting here screwing the town left and right and we should all praise him for it.... I have lived in Brick all of my life, and I am furious over the fact that Acropolis who has always been a respected member of the community has turned his back on us. So if you don't understand why people feel this way is because people like me are sick of him acting like a two year old with his outbursts and disrespect for his council and the people of this town.

Are you for real? Mayor Acropolis treated both Mayor Scarpelli, as well as Mayor Kelly, this way. The mayor is a bully, plain and simple. Do you remember how Councilman Acropolis treated Ed Mueller? View the online council meetings from those days to refresh your memory, and to show you what a real bully is. The only disgrace we have in town sits in the mayor's office. You want to talk about bad behavior? How about the mayor disrespecting Council President Ducey's authority and power as council president, and, therefore, the one who is supposed to run the meetings, not the mayor.
And I wish people would stop bringing up President Obama in comparing local issues. That's a whole different situation, since Executive Orders have been used by Presidents for many years: President Bush (both of them), President Clinton, President Reagan...it's a power that they have been given and is totally different from our situation in Brick Township.
Finally, I don't think anyone is applauding this behavior, as you stated. People are angry at having our town repeatedly thrown into turmoil by Steve Acropolis, both when he was councilman and mayor.

I now know from reading this that apparently threatening an officer is now something accepted in Brick. Our Mayor does not respect authority, or the council, not to mention the people in our town. He should step down, doesn't he realize that his power is dwindling down. I just hope this doesn't end like last time. You know where the council was standing up to our corrupt mayor and finally caring about what out town needs and they backed down, after some sort of understanding that council president and the mayor came too. Something needs to be done and I hope the council doesn't cave to our mayors bullying. Lastly, please let there be a fine at the very least for threatening a police officer!!! Unless our goal is to let the people of Brick know, the police officers do not hold authority and do not deserve respect.

This is just my opinion, BUT everyone needs to forget about whether these people (councilman, mayor, etc.) are Democrats or Republicans. The truth of the matter is that in local gov't neither sticks to the core principles of either party. For example, the Democrat council members are looking to reduce the size of gov't which is part of the Republican philosophy. Our Republican mayor in the past has always pushed for tax increases and gov't expansion, which is part of the Democrat philosophy. In local gov't, politicians typically flip-flop in whichever direction to maintain the support of the taxpayer and get re-elected. Therefore, I think we all need to forget about who's a D and who's a R when it comes to our town. We need to pay much closer to what these people are doing, as opposed to what they are saying.

I agree 100% Shell, the problem is $$$. The $$$ is in the two party tills. You know what's going to happen about 2-3 weeks from now!! Phone call after phone call. Mailer after mailer. TV ad after TV ad. Radio ads up the wazoo! Sometimes they knock on my door!! All of this takes $$$. People change parties to get elected when one of the parties is in the crapper. Ds in Brick four years ago were dead. The Rs screwed that up in two years! Who knows what the next election brings?

This political clash is not good for us-this is not a partisan issue. Everyone wants a cost savings but doing it illegally or refusing to compromise is not helpful nor is it going to save us money. Lawsuits by or against town officials are not free. Guess neither really cares.

@DennyD - Maybe I'm mistaken. Did Acropolis have Scarpelli escorted out of any council meetings? If he did, then that was wrong. Maybe I'm naive, but the office of Mayor should at the very least be respected, regardless of who holds it. You don't have to agree politically with that person, but you should be able to coexist and cooperate, for the good of the town. That is not happening here.

No I do not recall Scarpelli being escorted out. However, any time Acropolis told Scarpelli to be quiet, he stopped talking. Unfortunately Acropolis is a totally different person than Scarpelli. As long as Acropolis is mayor we're not going to see and big cut backs in spending or in gov't because his record of decision-making says he doesn't believe in all of that. The council should do what it can to reduce spending while we are stuck with Acropolis. But what we really need is someone to run against Acropolis in the next election that is the polar opposite of Acropolis when it comes to spending and the size of gov't. Personally, I would LOVE to see someone new come in, meet with all the department heads and say, "take a look at your budgets and present me a plan were you can reduce your department's budget by 20%. You reduce it or I will do it for you." That is the attitude we need.
And anyone who says their department can't cut back in any way b/c they are operating with the bare minimum is full of crap. If the taxpayer has to re-work their personal budgets constantly to deal with the loss of a job, inflation, tax increases, etc. SO CAN THE GOV'T.

Well if the Mayor vetos the ordinance it would need a super majority to be overrules. That would be 5-2. the vote went down 4-3. If Democrats are really reorganizing to create positions for their own friends, then nothing has changed except for the players. And most residents are fed up with the same old, same old! If real change is wanted, consider the following: non-partisan government; term limits (would need a change to the charter approved by the Legislature); election by wards and at-large so each section of town could have their own representative; a cap on capital spending beyond which public approval would be needed; a true ethics committee that does not consist of politicians, but rather members of the clergy and registered independents of the community to avoid partisan bias; (continued below)

Lori: Many feel that returning Brick to non-partisan government will never happen because the political parties would resist such a move. I believe that if the people are motivated enough, change can come about. Of course, if the Democrats now in control really wanted to show that they are for the people, they could pass an ordinance that would put the question of changing to non-partisan government on the ballot and the people could decide the issue. Another and more difficult way to have the question put on the ballot is for the people to do it by signing enough petitions using the Initiative and Referendum option offered by our form of government. If given the opportunity to decide, I believe the voters would opt for non-partisan government which would dramatically reduce the influence that party bosses, not elected by the people, have over local politics.

I'm sure you don't really know me, because if you did, you would know that I am an independent and have always been so. Yes, I supported local Democrats in recent years because I was not happy with Republicans working to get rid of non-partisan government in the late 80's. But let me give you a history lesson. In the mid 1960's I chaired a group of active young men (Brick Jaycees) that succeeded in changing the outdated partisan township committee form of government to a non-partisan mayor-council form. I served on the board of Education from 1967 to 1970, and then on the planning and zoning boards for a total of over 20 years. I had 8 years on the BTMUA where I was instrumental in saving $2 million during the reservoir construction because I fought a contract about to be awarded by the Republican majority to pay that mch for removal of the excavated soil. Instead we entered into an agreement with theMonmouth County who removed the soil at no cost for use at their landfill in Tinton Falls. (continued below)

The Republican controlled council backed down after a successful petition drive that would have placed the question on the ballot. I did all this without belonging to a political party! I wasn't there, but threatening someone with a lawsuit if hands were put on them is not a crime. If physical harm was threatened or physical resistance was met during an attempt at removal of a person from a public meeting as a result of causing a disturbance occurred, then charges could be forthcoming. It doesn't appear to have reached that level from what I am reading. The situation sounds like it was ugly, but not a crime. It also sounds like some tact was used by the Chief to diffuse the situation, nothing wrong with that.

My wife and I attended the meeting and the behavior that was displayedby by our governing body is a disgrace to our town. We the people, need to DEMAND more from our our pubic officials who should be acting as role models on how to handle conflict and disagreement. Instead they act like little children throwing tantrums when they don't get their way. If it wasn't already, it was very apparent last night that some of them are obviously more concerned about their own self interests and egos than for the improvement of the town. Time will tell if the proposed restructuring cuts the fat and ultimately will reduce or at least maintain stable taxes. If it doesn't work, then I guess we can all just expect a new ballot of clowns in the next election.

After watching the meeting on the internet, all I can say is its a sad time in Brick. Our mayor us such a bully. Why is it he can create and
"appoint" "political hacks" and the tax payers if brick just have to take it in the chin? Why do we have no recourse for his arrogance? He is a mean, vengeful person. I want to make it clear, I am not a D or R, I am NOT employed by the town I just want some relief so I do not lose my home. This town is horrible now. I just don't know what to say, I'm still shaking my head with disbelief

It reminds me of the time his son was in High School and bullied a Band member and knocked "her" down or the time he was found at a drinking party. The board of Education rule at the time stated if you are at any party you woukd be suspended from playing any extra curriculum activities , but being party of the hockey team at BTHS all eye's were closed when the BULLY Daddy came into the picture. Nothing like teaching your kids the golden rule in this case "THE ACROPOLIS RULE". This Mayor should go before the taxpayer's and explain his actions and apoligize.

Does anyone really think the Town's attorney cares if the employees sue? She, and her boss, are praying that they do. Cha-ching!!!! Does anyone really think that anything is going to change by writing in these blogs? Acropolis, Bellu, Pezzarus, and Lacey all read the blogs, then laugh all the way to the bank. Wake up people. @KC, in the last 4 years, property taxes have gone up 64% and debt has risen by 60 million. Please keep in mind, if the fly by night company building the solar field, decides to book, that will add another 34 million to our debt. Also since traders cove is a "work in progress" you can expect another 20+ million of debt for that. Then you have foodtown, and who knows what is going on with that, and what Steves redevelopment plans for it really are.

Good luck with that one since people are leaving the Republican and Democratic parties in droves, becoming the undeclared and a threat to the two party system. Nothing like splitting a ticket in the voting booth! It's dangerous having a Town Council and a Mayor that's all one party, I think we the people of this town have learned that lesson the hard way. Unfortunately we will have no choice in the next go round. I really do hope that the Democrats that have been elected and that will be elected shortly understand they weren't elected because of their party beliefs or their policies, but simply to get rid of some councilmen and in a years time the mayor and the rest of his people. The Democrats have to realize that they basically are a spare tire until the main tire can be retreaded and fixed. Those that work at getting this town back on track will become part of the retread those that don't will go back in the trunk where they belong.

JWB, your comments are well put. In my opinion political parties at the local level have little significance except to provide money and organization to candidates and to keep out the independents. When we had non-partisan government, anyone interested could run. True, they wouldn't have the "machine" to back them, but with no party designation in campaign literature or on the ballot, voters would have to do some thinking before casting their vote, thus giving independents a better shot at getting elected. Perhaps without the continuous partisan bickering we could have a local government that would actually work for the people instead rewarding themselves and party hacks…which we have seen too much of in Brick.

I agree with Dominick, Vinny is a good addition to our meetings and I enjoy seeing the Police Chief there also. I do question the reason why Ducey and his yes man Toth did not even open their mouthes when asked questions by the Mayor? Apparently as we all know, they did not want to be on record for affirming what the Mayor asked. Silence is a GUILTY act. Why did thet state opinions later after the Mayor walked out of the meeting? This was a good example of our elected officials not wanting to be exposed to unlawful actions. They make me ACRIMONIOUS.

Art, do you really believe it's guilt? I see it as they were not going to entertain that fool and dignify his ridiculous ranting. He went in there with a clear agenda, to embarrass the council. Well he did, ...furthermore he embarrassed himself even worse. Regarding Mr. Toth, did the Mayor copy EVERY request emailed to assist residents or businesses or just the ones that bolstered his argument? Come in Brick, Acropolis has been a thorn in the residents side for many, many years. He threw around his hate and disdain from the council seats, now he has a God complex going on from the Mayors seat. I think it's time to clean house, starting with the mayor and working through town hall. Get rid of all the overpaid hacks that have clearly shown they have their own agendas.

Councilman Moore was courageous and demonstrated that he Votes with his conscience and with knowledge of the facts presented to him by the Professionals and input from the People. He Put the People's Interest First! His understanding and earnest desire to serve the people of Brick Township is commendable. Hopefully, he is not pressured for voting with his heart and mind.

I just watched the meeting on the Brick web site, and all I can say is they should all be ashamed of themselves fot the tone of the meeking.
Kudos for those who voted no, for they had the sense to do what's right. To me it looked like a witch hunt by the new council members; how can you honestly vote yes with all the unanswered questions.

Those of you who believe in sweet talking Councilmen Dan Toth are in for a rude awaking. When he was the council's representative to the Land Use Department, he set up a sweetheart deal that allowed his stepmother to purchase a parcel of land from the township at a bargain price. She needed this parcel of land to make a business property she had up for sale on Cedar Bridge Avenue and Hooper Avenue more valuable. Further, to my knowledge Dan Toth is a member of the Township Redevelopment Authority, yet his father and stepmother who are in the Real Estate Business have actively brokered the foodtown redevelopment development site. Finally, Dan Toth talks about being committed to Brick Township and the strugglings mom and pop shops who are having difficulty running businesses in town, yet he moves his own wine business to Farmingdale, NJ. FLIP FLOP DAN - HE IS NOT OUR MAN.

Heard Ducey and Toth had it out big time today. Ducey is boiling mad Toth abstained from votes to do with liquor stores, then goes ahead and sends emails out to expedite certain things. In my opinion, Mr. Toth's financial gain evidenced from conflict of interest has JUST BEGUN TO SCRATCH the SURFACE. We have no evidence that Council President Ducey knew anything about Toth's abuse of authority and the driving force behind his actions. Until the Department of Community Affairs and/or Attorney General's Office investigate the Blatant Misuse of Power, I will give the Council President the benefit of the doubt. However, I hope he is more careful about the company he keeps. While the Council has every RIGHT to introduce such an Ordinance, they have only themselves to blame for NOT doing their homework. They can't keep blaming others for their lack of effectiveness on key matters that impact the Taxpayers.

I watched the meeting last night..Its a little scary to know that these people are supposed to be working together to make the best choices for Brick tax payers..I dont know how anything productive can come out of this group of people..Its clear they HATE each other. Its a shame and sad that the people of Brick will be the losers in this situation.

I do not agree with the way the Town Council went foward with this proposal which will
cost the taxpayer's additional Lawyer fee's from all ends - not only from the Administration & Council but from all the effected employee's being effected by the measure.
With regard to the Mayor stating this change is for political payback jobs for friends of the Democratic Party, did he forget the long list of friends that received this same status by he himself and his own party:
Belu & Francese along with the created Parks& Rec Department and the tranferred " Freinds & Family members prior to the DPW layoff's, Mr(s) Sangiovanni (BOE) and Brando (MUA) and Mr.Matthews (Housing Auth.) - please before you speak next time Mr.Mayor just think what you have not only did for your friends but also yourself when you received your job at the TRMUA after Mr.Belu received his large salary increase.

Given the cloud of uncertainty surrounding this Ordinance, I think that it would have made sense for more facts to come to light before action was taken. The explanation provided as to why a position was being created did not make sense to me at all. The claim that the clerk's office asked for more help doesn't equate to a need for another high-level position: DEPUTY CLERK. These people are not concerned about keeping your tax rate stable or lowering taxes at all, if you drew up a how and who has positions chart and listed their political affiliations you would certainly be amazed of the infinite amount of monies wasted everyday, and the only reason they fight so hard to resist change is they simply refuse to except they are the cause not the solution, the municipality and the mua are ridiculously filled with unnecessary positions and are nothing more than a funnel for our tax monies to their pockets, you talk about natural disasters this is a storm that never ends, they will exhaust every ounce of energy to resist change, you see it everyday, Mr. Acroploiis is certainly a great example of that!
