UPDATE: Beachwood Officer Shot Man Who Ignored Commands To Drop Handgun

52-year-old Beachwood man died of injuries, Ocean County Prosecutor's Office says

 

A man who ignored repeated requests to drop a handgun outside the High Velocity Sports Bar on Route 166 was shot and killed by a Beachwood police officer late last night, Ocean County Executive Assistant Prosecutor Michel Paulhus said.

Sgt. Bruce Harris was on routine patrol in a marked police cruiser when he encountered Mark Tanouye, 52, "causing a disturbance" near the sports bar on Route 166 around 10:50 p.m, Paulhus said.

Harris, who was in uniform, got out of his patrol car and confronted Tanouye in the sports bar parking lot, said Paulhus.

"He ignored repeated commands to drop his weapon," Paulhus said. "The officer discharged his weapon and the male suffered fatal injuries."

Tanouye was carrying a .25 caliber handgun. He was pronounced dead at the scene. His last known address was in Beachwood, Paulhus said.

Sgt. Harris has been placed on administrative leave while the investigation is continuing, which is standard procedure, Ocean County Prosecutor Marlene Lynch Ford said.

The state Attorney General's Office was notified about the shooting, Ford said.

"An investigation is being conducted by my office pursuant to the Attorney General’s guidelines concerning the use of force," Ford said.

Anyone with any information concerning this investigation is asked to
contact Detective Thomas Tiernan of the Ocean County Prosecutor’s Office at
(732) 929-2027.

Tanouye was last admitted to state prison in March 2008 and was released March 2012 South Woods State Prison, on one count of terroristic threats to kill, and one count of weapons possession for an unlawful purpose. The charges stemmed from an incident in May 14, 2006, according to the state Departments of Corrections.

On May 5 of that year, Tanouye impersonated a public servant, a charge which he also served prison time for, and used aliases such as Gregory Bartholomew, Bartholemew Dangalow, Mark Dangelo and Mark Tonouge, according to the state Department of Corrections.


The prison term was a mandatory 48-month sentence that carried a maximum of seven years.

The parking lot of the High Velocity Sports bar was roped off with police tape in the early morning darkness. Beachwood police, the Ocean County Prosecutor's Office, the Ocean County Criminalistics Investigative Unit and the Beachwood Fire Department were on the scene.

I am sure there will be many comments about this and that; yet in the end one man is gone and one officer has to live with the fact that he is responsible for that. I agree John Doe. None of us were there when it happened, and although I would prefer for everyone involved to have made it home at the end of the night, the fact is that this man caused a problem and pointed something at the officer. Regardless of whether it was a gun or not, which perhaps the officer could not see at the time, the officer was not only protecting his own life but others who were there as well. As for the comments from people who are saying that he was a "drunk, possibly unarmed man," this man got drunk on his own, and no one is to blame for that adding to the situation but him.
Its terrible what happened, but if the man lived and the officer got shot then all of these comments would be completely contradictory from what they are stating now. The officer did his job, a job he was trained for (despite comments about how cops are not trained, which is ridiculous...they are not just handed the job and a gun and sent on their way).

The people who are complaining that this officer had no right to shoot are probably the same ones complaining that "cops don't do anything" under all the burglary stories. Had he not fired his weapon, this could have been a story about a fatal shooting of Sgt. Harris, or a bystander. I agree with you- this officer is likely to suffer enough, without the heavy judgement of people who don't know any better.

I totally agree,I was discussing this earlier with my husband,because a friend of ours was beat up by a gang upon entering Mexico. But if you carry a gun there you can go to jail for 2 years[unpleasant place to be]. Then I said he should apply since he is Mexican[legally in this country] and I would apply here ,since I am American. If I may make a few minor corrections...Don't POINT a firearm at a cop, regardless of real or fake. All the cop sees is the apparent threat.
FYI...cops are civilians, only ACTIVE MILITARY are MILITARY. Free law-abiding citizens have the natural right, a Constitutionally RECOGNIZED right to preserve their own pecious life as well as the life(s) of loved ones and other victims of immediate deadly violence. That recognized natural right, however, especially in NJ, has been and is continuing to be abrogated, along with our other natural rights...UNALIENABLE as opposed to INALIENABLE...the Constitution does not give rights; it recognizes those rights. However, not too long ago, at a political rally of some type, Sen. Lautenberg, D, NJ, directed his hysteria at opposition protesters by empahtically stating, "What are they protesting? They're lucky that WE GIVE THEM THEIR RIGHTS". Yet "people will still vote for him...to wit: Chapter Three of "THE MUMMY RETURNS...AGAIN"!
It is absurd that the NJ legislature "Administratively" had made us all potential victims. Perhaps the only most obvious explaination for their betrayal of their SACRED OATH, is that, NJ is neither a republic nor a democracy, but rather an IDIOCRACY.

Beverly a little education for your ignorant comment in the people's republic of nj you have to have a firearms id card to purchase rides shotguns then to purchase a handgun you have to get a separate purchasers permit each time for each handgun only after strict background checks are done by state and local pd's then you can buy. Being a convicted criminal disqualifies you or being deemed mentally deficient also by law firearms are illegal in nj (check the criminal code it specifies) you may only possess them by permit or if you had them willed to you or you purchased from another state that you resided in BUT those firearms can only be held in you place of residence unless you get a firearms id card and register those weapons

Not sure if this posted before but will repost. My sympathy to the Officer who had to make that decision and stick with it. I would want that officer as my partner because the officer did not hesitate. Could have gone the other way and the officer would be dead you know. I would expect that since a Gun Shop is on the opening stages less than one block from the High Velocity, the police department will be busier than usual with concerns. Thank you Beachwood Police Department for great training and hiring! ( I am not a cop nor relative of one) but glad that our police are "ready" and let this be a message to those who think they are not TRAINED WELL!

Bill, so you suggest blinding or angering a man carrying a firearm? It doesnt remove the weapon from his hand and pepper spray only makes him blind, not stopping his ability to pull a trigger and kill or injure someone. And NJ doesnt have or allow police to use tasers, but that isnt a good idea either since being electrocuted produces sympathetic "clenching" in most muscles. If his finger was on the trigger, an electrical shock would have forced him to clench his hand, and pull the trigger of the gun. And Use a baton? so move from a position of relative safety and cover from a safe distance, to within 2 feet (arms length) of a man with a gun??? You're kidding right?

Police officers are tested for intelligence and if they score too high, they are not hired. I agree it is a thankless job that needs to be done, much like garbage collection and running sewerage plants. The gun draws the bullies that get off on wielding power. Sure there are good POs but these are few and far between, grossly outnumbered by sociopaths looking to get in their 20 and get out with a fat pension.

First off none of us that weren't there know what happened or not, secondly if an officer tells me to drop what's in my hand while pointing his weapon at me drunk or not weapon, bottle, eyeglasses whatever I would drop it, and lastly for all we know this man of 52 could have gotten shot anywhere and may have just died from blood loss or numerous other reasons. Let me put it to you this way....if someone yeilding a gun was breaking into your house, the first thing you would do is call the cops right? The same cops your calling "badge heavy goons". Say this person ignored all police warnings and was still on your front step waving the gun around ....would you be sitting there saying " maybe well take our chances, maybe the gun is fake" or would you be saying "why isn't the cop shooting him". Just because a select few have disgraced their badge doesn't mean they all do ...most actually care about their community and just like the rest of us care about protecting and keeping our families safe.

Jennifer I agree. I know this site is about opinion which is great but, I also get confused on why a difference of opinion results in insults back and forth. I think this is just going to be another dam if he does and dam if he doesn't. yes, I am sure there are quite a few of us that have run into not so nice or yahoo police, but, the fact remains they do put their lives on the line everyday. Most have families of their own they are trying to protect also. Let's see- he impersonated a public servant, has been arrested for other gun related charges and now people are wondering if he had a gun or not, really? It's unfortunate, but I'm glad the PO took this action, not to shoot him dead, but to protect the rest of us citizens from thugs like this. If this guy would have been any other place, maybe a residential neighborhood, this could have been way worse and innocent people could have been hurt.

How come nobody points out that this fine upstanding citizen should still have been in jail. He got a 7 year sentence in 2008 after having a long criminal history dating back to 1975, yet here he was wandering the streets with another gun.

There are good and bad in all professions. and the law certainly isn't always fair. Criminals are being released with slaps on their hand only to commit crimes again. This officer did what he needed to protect himself and the public that were present at High Velocity. If someone is pointing a weapon or threatening your life you don't aim for the leg or arm so they can still shoot you. Really people?

Beachwood Police Officer killed a known criminal/ex-convict...who was yielding a gun and told to drop it more than 3 times.

Kudos to the Officer who rid the world of another criminal. I'm sure everyone in High Velocity and the Beachwood Pub is happy the Officer stopped him as who knows what he would have done? Perhaps gone on a killing spree in one of the local bars or stores? We don't know....maybe he would have gone home....maybe not. Do you want to be on the other end of that "maybe".....I certainly don't.

My thoughts go out to the family and friends of both the Mark Tanouye and Sgt. Bruce Harris. In the end one man is gone and another has to live with the fact that he is in part responsible for that. We now know Mark did in fact have a weapon and Bruce directed him to drop it. Given the facts of this event and knowing the every officer knows and dreads when they join the force they too may one day be placed at this very same scene. However not everyone going to a sports bar expects this type of dangerous drama to be played out. Please keep in mind that there are Innocent families that are now suffering. My thoughts go out to all involved.

To MrCommon Sense. You might be right but he has a lot of friends and supporters posting here today. Some "experts" have been telling us how they would have handled it if they had the chance (such as shooting to wound or talking soothingly) but they probably would have done the same thing. But the rest simply either hate the police or are simply pro-criminal. Don't know why nor do I care. I just ignore them like a bug on the bottom of my shoe.

Police Officers do NOT carry tasters in the State of New Jersey. Police Officers are trained to hit the biggest target on the body (center mass), when your adrenaline is pumping you do not have the opportunity to worry about where you are shooting an individual. Your mind will be going 100mph at that time and you go into survival mode. Great job Sgt. Harris, Thank God you are safe.

Wow! You must watch too much television. I must confess that your comments here puzzle me. Do you think the average Police Officer really is really supposed to shoot a suspect in an arm or leg? Perhaps shoot the gun out of his hand? Maybe the officer should have picked up a rock and threw it at him? Perhaps tackled him, and tickled him until he let go of the gun? I try not to lend myself to insults so I will try to be nice. I don't know where you learned to place such unrealistic expectations on police officers. In my opinion, you really need to educate yourself better. Perhaps you should understand officers, like soldiers are taught to shoot "center mass", not an arm or leg. There isn't enough space here for me to explain to you why, but perhaps you can research that for yourself. My understanding too is officers are not allowed to use Tazers in NJ. But even if they were, would you really expect an officer to use a Tazer on a person with a gun? Please, I ask you to use your mind on this. In my opinion, we don't need a person to explain why he was carrying a gun and refused to listen to a police officer. He did not do as he was told, and the officer did what he had to do, period.

Police are not perfect, but have a difficult job to do. They are the ones that run into the bad situations that you and I run away from! It was a terrible situation and a choice had to be made, one that you have to be ready to make if you become a police officer. And that split second decision that an officer makes is debated by all the arm chair analyzers who were not there, and some of whom do not know the law or anything about police work. I am very sorry a man lost his life....but he had many choices leading up to that last choice not to drop the gun, and he was not making good ones. I know people who tried to help that man turn his life around....but he went back to crime....so many other previous bad choices in his life. It is very sad to see someone's life be lived this way and to end this way, but it was the result of his own choices. The officer will get counseling to help him deal with the trauma, and I hope he goes on to continue serving the public as a police officer. I pray for the families of all involved, that God will comfort them. And hopefully people will learn from this incident to avoid a life of poor choices and law-breaking. Life is too precious a gift to waste or to use causing hurt and harm to others.

If any one off you people who are critingicizing this officer were in that parking lot last night when this man was out there doing what he was doing and looking the way he did you would be ducking, running for cover and begging for this officer to shoot the man so that you could all get home to your families. You would not be feeling sorry for the guy. When someone you know and love is in law enforcement and they go off to work you tell them to "Be Safe" every time they leave you. I am very happy this officer got to go home to his family and that he didn't second guess himself. He kept himself and anybody else who could have been in that parking lot alive. Good for him!

I have a friend that was with the NYPD working what was the most murderous precinct he chased a young teen into an alley he hesitated and now has half his stomach. Police officers have to make split second decisions regarding their own safety and the safety of the public. From this guys history with the law, he had to have known that when a cop tells you to drop your weapon...you drop your weapon. Had the cop hesitated, he may be the one dead. Sorry that anyone died here, but the cop did exactly what he had to do if the recounting of the story is accurate.

Listen, Its a question if the officer felt threatened. The guy could of had a hair brush in his hand but when the officer said drop it and he didnt, then he raised his hand with something in it. He didn't comply and the officer felt that his life was in danger. Trust me the officer will never be the same.....

After spending the day in criminal court this week, I walked away wondering how cops even bother going to work every day. The system is fatally flawed and upside down. God Bless those who risk their lives to protect and serve.

I hope you all read the "man in the mirror" posting. I too have got to criminal court. I would recommend all of you go to your local court at least once a year, so you can see what our men and women in uniform go through on a daily basis. Maybe when you see it for yourself, some of you will change your opinions. Perhaps you can start looking at your politicians with a new set of eyes, since they are the ones who make the laws what they are, and so on. In my opinion, it will make you smarter voters too.

P.S. - For those of you who think the same as "Noodles". Perhaps you have lived a sheltered life, please educate yourselves, and REALLY think about what you would do in the same situation. Not that police officers are perfect, they are people just like us, no matter how much you may not want them to be. I thank God we have them, our firefighters, and our armed forces. In my opinion, you should too, and pray for them to go home safely to their families.

Also, for those of you who seem so embittered against the police officers, that there is no way they could do anything right in your eyes. Don't call them. I'm sure you have the same attitude toward our armed forces. Move to another country. Either way, you would probably be happier in another place other than the USA. I'm sure you can find someplace else to live where you can legally do the things you want to do.

The officer did what he had to do - his job!! He is there to serve and protect us, the public. The victim had a gun on him (why was he carrying it?) alot of other people could have been injured or possibly died if this guy went back into the bar and went bolistic. Looking at the post of his record, maybe he wanted to be shot to end his loser life.He was released from prison 4 months ago. Terroristic threats, unlawful weapons possession, impersonation of public servant, geesh. A police officer is a human being, he leaves his home everyday to serve and protect. His wife, children, etc. never know if when he walks out that door if he will be back after his shift. I applaud the officer for what he had to do, plus the fact the "victim", who has disregarded the law in the past, seems to me was not "rehabilitated" nor did he try to be. One less low life on the streets threatining the lives of others. Just saying.........

After reading everything, it is obvious who is at fault here, THE NJ STATE PAROLE BOARD. If they had kept this person in prison where he belonged, this would never have happened. But then again, most of the cop-haters would not be able to post here either. Hmm, we may be onto something now.

The Cops had NO right KILLING HIM!
Ok yes they needed to defuse the situdation & they DIDNT !
the man was so drunk the police could have taken him down easy... Or at least shoot him in the arm or leg to be able to contain him, INSTEAD they felt they had a RIGHT to kill him bcz of his past.... COPS DID NOT HANDLE THIS CORRECTLY!!! NO DOUGHT EXCESSIVE FORCE...
ok maybe he was not a model citizen, But he served his time, If the porole board felt he should have stayed in jail they had a chance to do so.... HE was a free man, & while he was not in his right mind being as intoxicated as he was, What was the officers excuse for making a poor decision?

If MT lived in Beachwood at one time he must have at least heard of him. I wonder if the town is notified when he was released? The article says Harris was on routine patrol, if MT was causing a problem at the bar, were the police called and a dispatch sent out, the dispatch logs would show that. Usually when something like this happens the press is all over the people that are at the scene for interviews, the people in the bar (maybe looking out the window) were there people in the parking lot when the shooting took place or across the street near the Beachwood Pub? Seems like everyone got out of there pretty fast except law inforcement. I guess that's why the investigation will take a while.

Dear Kristen, NJ Ghost, and take_the_power_back...
The shoppe that is opening in Beachwood is no assumption as it says in broad lettering right outside that it will be selling knives and other items that they call "gifts". So it is a weapon shoppe that has a skull and crossbones on the sign. The sign is home_made at best and a rental. I am sure they are within the guidelines of the NJ State and if you recall the shop in Toms River "Guns and Roses" is applying to buy and sell legal weapons too. So say as you wish, but the police department is "way" on top of every trashy looking new establishments that depict "seedy" looking signs and therefore one more thing to have to watch for trouble. And oh just so you know, I use to work at the Heating and cooling place that is now a Chiropractor establishment located next to the High Velocity. Several years ago it was the Thursday night police watch from the building window to the High Velocity for the drugs and license plates of those "dealing" who would show up. It was a good location and many handcuffs were placed on persons with outstanding warrants or drug activity. So I know exactly what I am talking about since I was "there" for the changing of the guards.Been living in Beachwood for over 25 years and have compliments for our Police Department. And believe me the Officer knew exactly who he was I am sure since they know who gets out of jail and is lurking around.

There is talk all around town that MT had a cigarette lighter that looked like a gun, the Prosecutors Office at this point says it was a gun. Where there any crime scene photos of the gun in his hand or on the ground next to him? Does that bar have video of the parking lot that captured all of this? Did Harris point his car with headlights at the MT and was his dash cam on? It won't change anything he was given a command but didn't respond correctly and the officer did what he thought was the right thing, but the truth is what the public demands. Some had the Duke players already going to jail until the truth came out. So, gun or lighter?

First of all, you need to learn how to spell~(politicions?). Second, it's not the bar; it's some of the morons that happen to stumble into the place! The owners~(John & Sean) are good people & they do their best to try to keep idiots like the guy that got shot out of their establishmment. Unfortunately~ that's not so easy to do these days and I'm sure that every bar owner will tell you that too! Like the old saying goes: "There's a rotten apple in every barrel!"
