6 Months in Jail for Brick Man Who Struck, Killed Teen

Patrick Doyle will begin serving sentence immediately

 

Patrick Doyle, the man who fatally struck and killed a Brick teenager on a skateboard in 2011, will spend the next six months in jail and lose his license for 10 years, a judge ruled Thursday night.

Doyle, 55, pleaded guilty to a single count of driving while intoxicated in front of Municipal Court Judge Daniel Sahin in Brick Township municipal court. It is his third DWI conviction.

In a May 11, 2011 accident, Doyle struck 19-year-old Anthony Briffa, of Brick, with his car, killing him. Briffa was riding his skateboard at the time.

Doyle's attorney, William Cunningham, told Sahin that his client's blood alcohol level was found to be .081, barely over the legal limit at the time of the accident.

Doyle admitted to Sahin that he had consumed four beers and two shots of whiskey the night of the accident.

The county prosecutor's office brought a vehicular homicide case against Doyle to a grand jury, however the grand jury remanded the case back to municipal court, meaning only the motor vehicle charge of driving while intoxicated would apply, rather than criminal charges.

Thursday's sentencing hearing became an emotionally-charged affair for both the Briffa family, who was present in court, as well as for Doyle.

"These mere words cannot express the extreme sorrow, remorse and apologies that I am expressing to you," said Doyle, adding that he has dedicated his life to young people as a coach and volunteer with special needs children.

Doyle's hands visibly shook as he began to tear up while reading a prepared statement to the Briffas.

"This is the hardest thing I've ever had to do in my life. I never meant to hurt your son," he said. "If I could've changed places with Anthony that night I would've done it. If I had to avoid that driver, swerve and hit a tree and lost my life, I would have done so."

Doyle said he is in counseling, prays every day and attends church at St. Dominic's.

Briffa's family also attends St. Dominic's where the teen served as a eucharistic minister before he died.

Toni Briffa, Anthony's mother, addressed the court briefly.

"I will live with the pain forever, as will my husband, my daughter and my son," she said, adding that Doyle "chose to drink and chose to drive" that night.

An emotional Maria Briffa, Anthony's older sister, gave a lengthy and tearful address.

"I lost my brother, but I also lost part of my parents," she said. "I wake up every day and I see the pain in their eyes, and they're just not them anymore. Holidays are so awkward now."

"I would come home from school, we would have our time, and it just meant the world to me," Maria Briffa recalled. "It's hard to care about work, it's hard to care about school, because he's always on my mind."

"I'm so, so sorry for your loss, and nothing I can do here can address that today," said Sahin, before imposing his sentence. "There is no way I could possibly do anything to make your lives any different at this point in time."

Sahin did, however, grant a defense motion for what is known as a "civil reservation" in the case, which blocks the guilty plea from being used in future civil proceedings.

Jacqueline DeCarlo, an attorney from the firm of Hobbie, Corrigan and Bertucio of Eatontown, representing the Briffa family, opposed the measure.

"The defendant was a drunk driver who was under the influence of both alcohol and marijuana, and as a result, someone is dead," argued DeCarlo. "How he wasn't indicted, I don't know, but he wasn't. And he's now in municipal court. It would be a travesty to have a civil reservation in this case."

Sahin said his ruling granting the civil reservation was because of the "borderline" blood alcohol level, as well as a lack of evidence that Doyle was speeding at the time of the accident.

"The .08 reading that was involved in this case is a borderline reading, and it's a reading most experienced DWI lawyers would take to trial," said Sahin.

Cunningham had argued that the blood alcohol reading could have been disputed.

"This by no means compromises your civil rights, and I think you're going to find that," said Sahin, addressing the Briffa family.

Doyle will begin serving his sentence immediately at the Ocean County Jail. He was taken out of the courtroom by a police officer.

This is Terrible reading this...I just moved to Brick Aug 2011...and reading this for first time...I will be saying prayers for the victims family and may he RIP...

And may the driver rot in hell and KARMA is a bitch...I am a true believer in EYE FOR AN EYE... this guys does not deserve to breath this air we live....He lost that right drinking...doing drugs and driving under influence.... My best friend in 1990 was killed by drunk driver and got the same sentence.....FUNNY HOW THINGS NEVER CHANGE...

SO WRONG....WHERE IS THE JUSTICE SYSTEM... because this dirtbag will get out and still drink and drive...with or without license... A LEOPARD NEVER CHANGES ITS SPOTS!!!!!!!!!!!!!!!!!!!

That's not true. For one, you never drove drunk before?? Because remember.. the legal limit is ".08". I'm not glorifying what this man did, but you never know the circumstances of the entire story!! It is really sad what happened to the pedestrian, but how do you know the pedestrian was not at fault themselves?? I love how people sit there and wish these harsh sentences upon people when they're blinded by what's going on in their own lives. Instead of sitting there and wishing all these evils upon someone for making a MISTAKE.. because let me tell you how many people sit there and judge people for this type of accident when they were just at the bar Friday night getting drunk and hauling ass from the cops to avoid a DWI.. pray for the family of the victims! And guess what.. leopards can change spots.. because I did!!! You make me sick.

Apparently a 19 year old mans life is only worth 6 months. If I or someone else was behind the wheel of that automobile at 10:13pm on May 11th we would be in jail for 15+ years. I was in the municipal building tonight and while "justice" has been served. It hasn't. Rest in Peace Ant we all miss you.

I find the outcome of this atrocious. Doyle was driving drunk, under the influence of marijuana and most likely speeding and HE KILLED AN INNOCENT CHILD. Anthony might have been 19, but that's a child. Doyle took a life before it had truly began. where the hell is the justice for Anthony?!?!?! I am sorry for the loss of this young man! It is a horrable thing that had happend, No sorrow or grief will ever bring this him back, and that is what makes this harder for everyone. I am also sorry for the choices that were made that night by Pat, he has always devoted his life to the young people of this town. All of the amazing things that he has done in life was all taken away because of a horrible accident. I hope people learn from this. I do not ever drink and drive, not even one drink because I don't want to every have to think, "what if". I do drive in this area and hope that sidewalks are something the township will consider. So many pedestrians die all of the time and it is just sad. Forever this family will be withoute child, and Pat will alwasy wish it were him instead.. This could have hapend to so many people and that makes me sad.

Firstly I'd like to note the ONLY time tears came to my eyes is when my mother, and sister spoke and made me realize how much our family life has changed because of this.

Secondly regarding that piece of shits "Apology". Apologies must be sincere, completely true, and accurate to what you say. Doyle lied TWICE to our fucking faces.

During his sob story he was on the topic of the accident and location and why he sped up. "the car slowed down, and appeared to be lost looking for a road"

There are no crossroads, or street signs where he claimed the car looked confused, and where the accident happened, ...HIS decision to speed up and pass it.

His second lie was to our church. I was told by my mother a few weeks after the accident that he spoke to one of the church members and told them he did NOT Drink that night. However his remark during the apology was the opposite.

Vincent, first let me say the whole neighborhood is sorry for your loss. I pass the memorial on Jordan almost daily and I always say a little prayer as I do. There is another issue that I thought would have been addressed as well and it hasn't.. Jordan Road is a very dangerous road, has been for years. I lost two childhood friends on that road. After Anthony passed I wondered if that would be the final fatality on that road to start producing improvements to Jordan, such as installation of sidewalks the full length of the road as well as making the whole road a no passing zone, improve the lighting and most important of all the reduction of the speed limit. Not only am I disgusted by the outcome of the "trial" but also by the inaction of the county or the township to improve the safety of Jordan Road. What is it going to take? Another death? Another memorial on the side of Jordan for them to finally do something about Jordan? I find the situation inexcusable on the part of the county and it's inaction to improve safety and the town for the "trial".

Vincent, you are correct, his apology has no sincerity, if he really cared, he would have stopped driving drunk after his first DWI conviction. I also understand that he said he was under the influence of marijuana, this guy has been a menace to the residents of Brick for a very long time, and now because he played high school hockey with the mayor, he gets off with a slap on the wrist. You and your family should be upset, I'm very upset, because as a retired police officer, I know how easy it is to get an indictment by the county prosecutor, the prosecutor didn't try for an indictment because Doyle is politically connected.
I am extremely upset with the outcome here, I wish we could ask for the state attorney general to look into the case, but, same political party, Republican, that controls Brick and Ocean County, so they won't do anything.
This is a very sad lesson for the youth of Brick, to show that you have no power unless you are politically aligned with those in power.
My comments may be removed shortly because the patch doesn't like when I attack it's political friends.
Finally, Anthony taught my son to play lacrosse, they became good friends, I want you and your parents to know that there are many strangers to you, that know and love Anthony and we will keep his memory and your family in our prayers. Stay strong and keep up the good fight!

The family will file a, "Wrongful death suit" in Civil Court. Money makes up for no loss of life, but after this piece of crap spends 6 months in jail, why not go after him where it may hurt him the worst. His wallet ....

When is enough going to be enough and laws against intoxicated drivers become stiffer. When people drink and drive, they don't care about anyone else on the road but themselves. Their car should be immediately impounded and not be given back. They should lose their license, and spend no less than a minimum of 1 year in jail. Accident or not. Mandatory. And, in this case, if you kill someone, you should receive at least 10 years, with no parole.

DWI laws are frivolous ... they hit you with fines, penalties, debt. There is no real lesson learned.

The problem in this case is that the county prosecutor failed to do his or her job because Doyle is politically connected within the township and the same party runs the county. It is kind of stupid that our criminal justice system depends on whether you belong to the political party that's in power at the time you are charged. Or not charged because as we all recall Doyle was never taken into custody after killing Anthony, that blood test to determine if he was over the limit came many hours later. I wonder, did any police officer note this?, Did anyone calculate his blood alcohol content back to the time when he killed Anthony? Oh, yes, this is done routinely in DWI cases when the offender is not politically connected.

If you want the DWI law change then contact your officials. In Nassau county, Long Island, if you get arrested for DWI with some dead. the District Attorney Rice will make sure your going to jail. She doesn't put up with nonsense. The person that gets DWI without hurting someone is heavily fine, loses his license, alcohol counseling and a breathe analyzer in their car when they get a license for several years.

Lee I hope your children don't go to the improved parks in brick or the fixed up skate park cause the "cry baby" was in charge of that! I do not take away from this family'.s loss. I think it's sad that he has done so much for this community and you feel that you have the right to take that away.. What he did was wrong.. He lives with that ever day.. His apologies was not an act.. If he tried he could have gotten even less. He was barely over the limit and it was an accident.. I would never wish this on anyone and I feel deeply for his friends and family.. I also feel deeply for Pat who has spent most of his life devoted to the children in brick. He loved them all. Went out of his way helping troubled youth and disabled children. I do not believe and can not believe that he wanted this to happen in any way. I think that this is sad from all angles but to take away the good that he has done and make it seem like he is a monster is stupid. He knew what he did was wrong and plead guilty. If he was so "devoted" to helping troubled youth and disabled children, he would have gave up the drugs and alcohol after the first DWI. What good has he done? What did he teach the kids, that it is ok as long as you don't get caught. Yes, he is a kind and caring man but he is also a selfish one. Now a young man is dead, a family is grieving and the kids he helped were let down. This is no "accident" it was a decision to get behind the wheel of a car and put the lives and safety of others in harms way. I feel no pity for him. The next six months will be hard for him because he will have to face facts without a bottle.

I couldn't give two shits what he has done in the past, you are who you define yourself to be on a DAILY basis.

Secondly it was an accident when he put the keys in the ignition and started his vehicle. In addition, IF he was sober maybe he wouldn't have veered off the OPPOSING lanes shoulder to pass the car in front of him, and would of been able to swerve right and avoid Anthony. You want photos of the skid marks he created? I was there that night taking photos to ensure everything was covered. BUT HE WAS DRUNK SO HIS REACTION TIME WAS DELAYED.

So it would be in your best interest to think before you post. I mean unless you want to show the town that you are incapable of analyzing the facts, processing them, and giving an educated comment.

Not really sure what your point is. Booze is an intoxicating substance too do you want to return to the days of prohibition? That worked out about as well and the joke war on drugs is today. The substance doesn't matter at issue are the actions of people who CHOSE to get behind the wheel while intoxicated - doesn't matter if it's booze, weed or RX drugs.

His so-called "apology" was an insult to the family and this community. I was present and it sounded more like a plea for ebveryone to feel sorry for him- not an apology for actions that took the life of a wonderfal young man. It was also insulting that Board of Education members- John Talty, Sharon Kight- allowed their public office to be used in defense of this creep. Shame on them and if they do not get booted out immediately, or have the sense to resign, they should be voted out as soon as possible. What lesson do they want our children to get from this sad occasion?

Let me get this straight on Dec 18th a 60 year old woman crossed a double solid line on Herbertville Road,collided head on with another car killing the driver a 65 year old woman..The 60 year old woman get out of the hospital and is immediately arrested and put in jail... Patick Doyle get behind the wheel of his car drunk and high from marijuana on MAY 11 2011 and has been walking around FREE getting behind the wheel of a car, golfing and hitting the bars and it is NOW JANUARY 2013 and he is just being sentencedor should I say SLAPPED on the wrist!!! This Town, the courts, judges the Mayor and anyone else that gave any input and or help to reach this sentence should be ashamed of themselves, I know that I along with a lot of other residents in this town are ashamed of them!! Justice was NOT Served in Bricktown for Anthony Briffa!!!

I had the same reaction as you! How could that poor 60 year old woman be charged with death by auto and not Doyle? I don't even think she was treated to having the Toms River Police come in to investigate her accident, like Doyle had. Which only delayed his blood alcohol test a few hours.

I too had the exact same reaction to the Herbertsville accident. I think the Doyle sentence might set a dangerous precedent in this town for drunk driving. Even though the circumstances in the 60 year olds accident may not be exactly the same, if I were her lawyers I would demand the same sentence for her as Doyle got. With a little difference if it didn't involve alcohol or she's hasn't had a DUI in the past. In which case it would be a six months sentence with time off for good behavior, it this what we want in Brick? I say no. I know the Briffa family has a lot on their plate, but I would also go after the county for NOT improving Jordan Road over the years and that some of the dangers of Jordan also factored into the death of their son besides Mr. Doyle being drunk.

My final comment was too long for the editor. So let me make my case without all the justifications I had included, anyone who has a problem with that , comment and I will reply yo you.
Anthony Briffa was a great kid, and he was just a kid, a teenager. I feel for his parents and pray for Anthony and his family.
Pat Doyle got all he could get in municipal court. The county prosecutor failed the Briffa family by not seeking an indictment in this case. They can bullshit as much as they want but as a cop I know "you can indict a ham sandwich", they didn't try, politics. Republican mayor, republican county. I said go to the state attorney general, but, another republican.
Pat Doyle feels sorry for himself, that is why he cried at his hearing. He doesn't care, he is special, he has friends to protect him. His third DWI and how many more that they let him skate away from? He cares about kids, about the same as Jerry Sandusky cared about kids, he liked hockey and wanted to be around hockey. That hockey tradition forged a life long friendship with Mayor Acroplois and that is what saved his ass from a manslaughter charge.
RIP, Anthony Briffa, our prayers are with the Briffa family.

Some of you I know some of I you don't but I want to THANK YOU all for your support and prayers!!!! Whether it was 6 months or 60 years nothing will bring back my son. The justice system in this town does suck!! Shame on the people who should of done the right thing but didnt!!! They will have to put there heads on their pillow at night knowing they did wrong.. I wanted to give this man the benefit of the doubt that when he told our Monsignor he wasnt drinking. But i guess i was wrong!!! He lied through his teeth that day and to the Judge, His apology he can shove up his ass!!! How dare he even put Anthony's name in his mouth in front of my family. Yes 3rd DWI, Yes Marjuana, Yes Speeding and Yes a cover up from the begining. I will never forgive him as long as I live. First and foremost my heart aches for this poor family. I have to ask, can't this cover up be brought to a higher level for an investigation of all individuals involved? The judge, the attorney for Doyle(who used to be asst prosecutor), the people who kicked this back to municipal court (why), and all who investigated this case. How can someone who's blood was tested and results were legally drunk and under the influence of marajuina walk away after six freakin months. This guy is a lowlife and mommy and Patty's friends have gotten him no show jobs his entire life. That is except for his drunkin djay gigs. If I were this family I would not quit and I'd be in Trenton first thing Monday morning. They deserve justice for their beloved son and brother.

This just in: A Howell man was sentenced Friday to 15 months in PRISON (not county jail) for defrauding an Illinois man out of nearly $50,000.00. Yet this scumbag doyle gets only 6 months for killing someone while being convicted driving drunk for the third time. I'm glad I don't live in Brick, but I can smell something awful going on here. Hell, Helen Keller would know there was something wrong here! But as far as doyle and that judge, they'll have to answer to an even higher authority some day. Jack

This is very sad and unfortunately it has happened before, and will probably happen again unless the law changes. In order for a person to be found guilty of vehicular homicide in NJ, the prosecution must prove three elements beyond a reasonable doubt. 1) That the defendant was driving a vehicle, 2) That the defendant caused the death of the victim and 3) That the defendant caused such death by driving the vehicle recklessly. The law further states that: “…Proof that the defendant was driving while intoxicated in violation of R.S.39: 4-50 shall give rise to an inference that the defendant was driving recklessly.” In other words, proof that the defendant’s blood alcohol level was in excess of the legal limit is only a factor for the jury to consider in determining if the defendant drove recklessly. The way the law is written, a blood alcohol level in excess of the legal limit does not by itself; automatically mean that a jury must find the reckless element to be satisfied. And that is where the problem lies. Until legislation is passed that amends the statute to say that a BAC above the limit is per se recklessness, crimes like this will continue to go unpunished, particularly with cases involving borderline BAC’s. It is clear that we need tougher laws that address this so that justice can be served accordingly. As to the indictment, without knowing what evidence was or wasn’t presented to the grand jury it really is impossible to say why they declined to indict.

Quah, my guess is that if someone doesn't learn their lesson after the first DUI, they probably never will. Maybe it should be against the law to have any in your system after two or even after one. Until there are more serious consequences, people will continue to take the risk of maybe getting pulled over or maybe getting away. And those of us who don't still risk sharing the roads with them. I am sure there are more people that drink and drive and don't get caught than there are that do get pulled over. Go to any bar on a Friday night and count the number of people pulling out of the parking lot at last call.

It is in the works.

Not only am I making sure anyone involved in the case from start to present is on the hot spot. But I will also be pushing for DUI laws to be more severe and additional penalties inquired. In addition, I will make sure the town feels the there share of the pain by petitioning sidewalks on all neighborhood streets and any relevant areas.

There is a lot of work to be done, and I will not fail nor be silent.

My advice is be careful with the fighting for more laws. We do not need more laws. Your brothers drunken killer broke many laws but he still only got 6 Months because of who he knows. Fighting for more laws only will punish JUST US. And that's the kind of justice they like best. Stay strong.
